_____________________________________________________________________________________ <br /> <br />Staff Report | Braewood Hills 3rd Addition (PDT 24-1 & ST 24-3) <br /> <br />EC 9.2741(4)(a): Middle Housing is permitted on the following lots: <br />1. A duplex shall be permitted on: <br />a. Any lot or parcel where a single-unit dwelling is permitted; and <br />b. Any lot or parcel with a lot area that is at least 2,250 square feet. <br />2. A triplex shall be permitted on any lot or parcel with a lot area that is at least 3,500 <br />square feet. <br />3. A fourplex shall be permitted on any lot or parcel with a lot area that is at least <br />4,500 square feet. <br />4. A cottage cluster shall be permitted on any lot or parcel with a lot area that is at <br />least 4,500 square feet. <br />5. Individual units of middle housing are permitted on middle housing lots created <br />pursuant to a middle housing land division. <br /> <br />The applicant’s written statement includes a table demonstrating that all lots within the <br />proposed subdivision exceed 4,500 square feet and therefore, duplexes, triplexes, fourplexes <br />and cottage clusters would be allowed on each of the 38 lots (but not on Lot 39 as discussed at <br />EC 9.8325(8)(a)). In accordance with Policy A.9, the maximum density for middle housing is not <br />otherwise limited beyond the minimum lot standards described above. <br /> <br />Based on the findings above, this criterion is met. <br /> <br />EC 9.8325(3): For areas not included on the city’s acknowledged Goal 5 inventory, the <br />PUD preserves existing natural resources by compliance with the provisions of EC <br />9.6880 to EC 9.6885 Tree Preservation and Removal Standards <br /> <br />The subject property is included on the City’s acknowledged Goal 5 inventory, per the April 12, <br />1978, Scenic Sites Working Paper, which is adopted as an inventory of significant Goal 5 <br />resource within the City of Eugene by Ordinance No. 20351. The Scenic Sites Working Paper <br />designates the subject site as one of the Natural Sites of Visual Prominence and Prominent and <br />Plentiful Vegetation. Additionally, a protected upland stream corridor on the subject property is <br />listed on the City’s adopted Goal 5 Water Resources Inventory (2005), as reflected by the /WR <br />Water Resources Conservation Overlay zone for this property. As such, this criterion does not <br />apply. <br /> <br />Staff notes that in the absence of any exemption under an approved tree removal or <br />preservation plan for the Tentative PUD or Subdivision as specifically allowed under EC <br />9.6885(1)(c), the Tree Preservation and Removal Standards at EC 9.6885 will apply directly at <br />the time of future development depending on the timing and scope of tree removal, lot size, <br />and other factors that may require a separate tree removal permit under the requirements of <br />EC Chapter 6. <br /> <br />EC 9.8325(4): The PUD provides safe and adequate transportation systems through <br />compliance with all of the following: <br /> <br />Page 10 of 87
