The property is zoned C-2, is approximately 0.8 acres, and is situated <br />between River Avenue and the Randy Pape Beltline. <br />Currently, 121 River Avenue is leased to Action Rent -All & Events, a locally owned and operated <br />business that has been located on River Avenue since 1984, for 40 years. The business includes a <br />catering service and the rental of light and heavy equipment. Of the total business revenue, about <br />30% of the catering service revenue and 90% of the equipment rental is from local customers, <br />people living and working in the River Road/Santa Clara (RR/SC) area. <br />The proposed code amendments have already impacted my client as the uncertainty and potential <br />restrictions have chilled a relocation and expansion by Action Rent -All & Events to adjacent <br />property. In addition, my client is highly concerned about implementation of the C-2 specific code <br />amendments and how they will affect his ability to replace the tenant, especially as the Planning <br />Commission never examined the potential effects of the proposed building standards under EC <br />9.2170 (aside from building height).
