Recyclability. The business will be negatively impacted by new standards that thrust the <br />existing building into the category of a nonconforming structure. <br />Action Rent -All & Events is transitioning away from gas powered equipment to battery powered <br />equipment. It is a slow process that requires additional space to store equipment, additional <br />technical training for employees, and education to customers on how to use battery powered <br />equipment. The C-2 zone prohibits outdoor display of merchandise except for certain items such <br />as large equipment. For Action Rent -All to transition away from use of fossil fuel, it requires an <br />increase in the building square footage to store medium and small battery powered rental <br />equipment. <br />The proposed RRSC code amendments will create an excessive financial burden on small, <br />locally -owned businesses by imposing RRSC specific standards. <br />For the reasons detailed above, we respectfully request the City Council reject in total the <br />adoption of the proposed RRSC code amendments. However, If the Council decides to adopt <br />the proposed RRSC code amendments, we request carving out River Avenue from both the list <br />of prohibited uses as well as the development standards. <br />Prohibited Uses <br />Carve out River Avenue and include a map and list of tax lots in the adopting ordinance <br />that are not subject to the list of prohibited uses. <br />Building Height <br />Carve out River Avenue since the unique characteristics of the area do not warrant the <br />height restriction and decreasing the maximum building height to 65 feet conflicts with <br />city policies promoting compact growth, increased residential densities, and mixed uses. <br />Minimum Front Yard Setbacks - EC 9.2170(4)(b)2c <br />Carve out River Avenue since this standard will not be applicable. Subsection 2c will <br />only apply to properties that have frontage on River Road. <br />Maximum Front Yard Setbacks- E 9.2170(4)(c) <br />Carve out River Avenue from subsections 3 and 6. Subsection 3 will require a minimum <br />of 80% of all street facing facades to be within a maximum 15 -foot setback. This <br />proposed change will create a burden on existing businesses, hinder financing, and limit <br />redevelopment options. In addition, the draft code does not provide an exception for <br />double frontage lots such as those facing River Avenue and Randy Pape Beltline. <br />Subsection 6 will not be applicable to properties on River Avenue since it will only apply <br />to properties with frontage on River Road. <br />RRSC Specific Standards — EC 9.2170(13) <br />Carve our River Avenue as there are no properties zoned C-2 abutting R-1 properties. <br />Moreover, standards related to building walls, window coverage, and weather protection <br />RRSC Code Amendments Page 3 of 5X019 BISHOW <br />Bishow Testimony March 4, 2024 dM CONSULTING <br />20 <br />
