March 4, 2024 <br />Mayor Vinis and Eugene City Council <br />Sent Via email: RRSCPlan (a)eugene-or.gov <br />RE: RRSC Plan — Code Amendments (City File 23-2) <br />Dear Mayor Vinis and City Councilors: <br />You have likely received excellent testimony from local land use attorneys and land use planners. I have read <br />their testimony and agree whole heartedly with their comments. <br />In addition, I offer you these brief comments and the attached images, as prior testimony has covered much of <br />the other territory quite well. <br />One of the greatest impacts the suggested code amendments will have is to require every existing business to <br />apply for an Adjustment Review if they choose to expand their business. They will not be able to meet the <br />required maximum setback from the street. <br />Attached is a document depicting all C-2 properties in the RRSC Plan area and their uses. I thought it might be <br />helpful for you to see in an air photo the businesses / building owners that will not be able to comply with the <br />proposed draft code criteria for development (new buildings or building additions) of the property. <br />An Adjustment Review is a land use application complete with unnecessary cost and delay. It then opens the <br />applicant up to appeal. In my extensive experience with land use applications Adjustment Reviews are typically <br />approved. <br />It is important to ask this question: `If they are always approved and there is no discernable gain to the public. <br />then why require them?' <br />Another relevant question is: "Why are zone specific code amendments being proposed as part of a <br />neighborhood refinement plan?" <br />Please consider the affect of these code criteria on our local businesses and building owners.
