Response: Proposed Lot 1 meets the solar lot requirements delineated in EC 9.2790 (2), above. For proposed Lots 2 — 5, the <br />applicant is requesting an exception to EC 9.2790 (2), per EC 9.2790(3)(b)(1) and addressed therein. <br />(3) Exceptions to the Solar Lot Requirements. A proposed subdivision shall be exempt from EC 9.2790(2) if either of the <br />following exists: <br />(a) Density. The proposed subdivision provides at least 70% of the maximum allowed density according to the <br />zoning of the property. <br />(b) Site Constraints. One of the following circumstances is present: <br />1. Compliance with applicable street standards or public street plans requires a street configuration that <br />prevents the lots from being oriented for solar access. <br />2. An existing public easement or right-of-way prevents the lot from being oriented for solar access. <br />3. There is a significant natural feature on the site, identified as such in the comprehensive plan, <br />adopted refinement plan, or in any city -adopted natural resource inventory that will continue to exist after <br />the site is developed, and that prevents the lot from being oriented for solar access. <br />Response: The applicant is requesting an exception to the Solar Lot requirements in EC 9.2790(2) per Subsection (3)(b)(1), above. <br />Due to the east -west orientation of Bushnell Lane, the north -south orientation of the access and the existing development <br />surrounding the subject property, it is not possible to orient an east -west street within the site. <br />17r 9,P515 /1l ` r{l�rl%!!{�ig�{7, T?,nfi0vP Plan AnprC°vo/ Criterin <br />(b) EC 9.6800 through EC 9.6875 Standards for Streets, Alleys, and Other Public Ways; and <br />9.6805 — Dedication of Public Ways. <br />As a condition of any development, the city may require dedication of public ways for bicycle and/or pedestrian use as <br />well as for streets and alleys, provided the city makes findings to demonstrate consistency with constitutional <br />requirements. Public ways for pedestrian and bicycle accessways, streets and alleys to be dedicated to the public by the <br />applicant shall conform with the adopted Street Right of way Map, and EC Table 9.6870. <br />Response: Noted. Should the city require it, any requested dedications can be made a condition of the tentative approval. <br />9.6810 — Block Length. <br />Response: No new streets are proposed with this tentative subdivision plan. This criterion is not applicable to this proposal. <br />9.6815 (2) — Street Connectivity Standards. <br />(a) All streets and alleys shall be public unless the developer demonstrates that a public street or alley is not <br />necessary for compliance with this land use code or the street connectivity standards of subparagraphs (b) <br />through (0 of this subsection. <br />Response: No streets or alleys are proposed with this partition plan. No housing is proposed at this time. Subsections (b) through <br />(f), addressed below, demonstrate the proposal's compliance with street connectivity standards. <br />(b) The proposed development shall include street connections in the direction of all existing or planned streets <br />within 114 mile of the development site. The proposed development shall also include street connections to any <br />streets that abut, are adjacent to, or terminate at the development site. <br />Response: Bushnell Ln, abutting the subject property, is developed throughout connectivity routes in all respective directions within <br />'/4 mile of the proposed subdivision. No streets terminate at the development site. No new street connections are proposed. <br />
