2/16/2024 <br /> <br />2 <br />A. ORS 92.031(2)(b) <br />With respect to the application’s compliance with ORS 92.031(2)(b), the Applicant asserts: “Separate <br />utilities are provided. See attached Utility Plan.” <br />There is no attached Utility Plan. <br />The only evidence in the record is an exchange with EWEB regarding the increased need at the street to <br />provide electricity to the edge of the street, not to the individual units/lots themselves. The provided evidence <br />from EWEB clearly states that those plans and materials must be supplied, paid for, and designed by the <br />Applicant. As EWEB states: “There are no design or installation specifications confirmed at this time.” <br />There is no plan for the provision and or routing of the electrics service to all four lots/building sites. <br />Indeed, the only map in evidence for the proposed electrical service shows that EWEB has only reviewed a <br />proposal whereby the electrical is adjacent to the access easement on the south end of the property, while the <br />site map provided in the supplemental materials by the Applicant shows the utility easement running on the <br />north end of the property on the other side of the existing dwelling. <br />In addition to the insufficient evidence of electrical utilities to all lots/dwellings, there is no information <br />or evidence regarding the other utilities and their provision to the lots/dwellings (sewer, wastewater, etc.). <br />No reasonable person would rely on the Applicant’s unsupported assertions and citations to evidence not <br />in the record. Therefore, the Applicant has failed to demonstrate with substantial evidence, and in some cases <br />provides no evidence at all much less substantial, compliance with ORS 92.031(2)(b). For this reason, the <br />application should be denied. <br />B. ORS 92.031(2)(c)(A) <br />With respect to the application’s compliance with ORS 92.031(2)(c)(A), the Applicant asserts: <br />“Both access and utility easements are provided per attached Tentative <br />Plat which provide electricity, water, sewer and stormwater access for <br />each home per the Utility Plan (conceptual, currently in permit review). <br />Further confirmation is provided as follows: <br />1. Electricity: EWEB has provided an electrical design which will <br />service the four new dwellings. We will bring service from the pole
