This TIA application was submitted on April 5, 2023, and subsequently deemed complete on <br />August 25, 2023. Shortly thereafter, City staff and the applicant became aware of concerns <br />raised by Lane County Transportation staff with truck movements on Clear Lake Road, which is <br />under Lane County jurisdiction. The applicant requested several time extensions prior to <br />issuance of this decision while the applicant's traffic engineer worked on the issues related to <br />traffic control and subsequent permitting requirements with Lane County and City staff. <br />This Traffic Impact Analysis (TIA) Review is a Type II land use application, and the approval <br />criteria are found at EC 9.8680. The relevant Type II application procedures are primarily <br />addressed at EC 9.7200 through EC 9.7230. The following evaluation includes findings of <br />compliance with the applicable TIA approval criteria and related standards, subject to one <br />condition of approval to ensure that Lane County's permitting requirements are met for access <br />and traffic control on Clear Lake Road. <br />For additional background information and details on the applicant's proposal, please refer to <br />the applicant's written statement, site plan and additional materials within the application file. <br />Referrals/Public Notice <br />The Planning Division provided information concerning the application to other appropriate City <br />departments, public agencies, service providers, and the affected neighborhood group. The <br />Planning Division also mailed written public notice of the application on September 1, 2023. No <br />public testimony was received. <br />Referral comments were received from the City of Eugene Public Works Department and Lane <br />County Transportation Planning. Those referral comments incorporated into the following <br />evaluation are in respect to applicable approval standards and are also included in the <br />application file for reference. <br />Traffic Impact Analysis Evaluation <br />As noted above, this request is subject to the Type II land use application procedures, which are <br />primarily addressed at Eugene Code (EC) 9.7200-9.7230. The following evaluation also <br />addresses details of the proposal in the context of compliance with the applicable approval <br />criteria and related standards. <br />More specifically in this case, under EC 9.8670(4), a Traffic Impact Analysis Review is required <br />when a development abuts a street in the jurisdiction of Lane County and will generate or <br />receive traffic by vehicles of heavy weight in their dailey operations. In this case the site abuts <br />Clear Lake Road, which is under Lane County jurisdiction, and the proposed use of the site will <br />take access from Clear Lake Road and require the use of heavy weight vehicles in their daily <br />operations. <br />Based on referral comments from the City's Public Works Engineering staff, the applicant <br />submitted the required TIA in conformance with the applicable standards identified in EC <br />9.8675. <br />January 17, 2024 Findings & Decision: TIA 23-1 Page 2 of 6 <br />
