Site Characteristics and Present Request: <br />The applicant is requesting approval of a zone change from R -1, Low Density Residential and 1 -3 Heavy <br />Industrial to R -2 Medium Density Residential. <br />The subject property is made up of five tax lots that total approximately 1.75 acres in size. The subject <br />property has one single family dwelling on it that is currently under construction. The property is just <br />northeast of the intersection of two arterial roads with a Maxwell Road Bridge crossing over Northwest <br />Expressway. The area to the west is predominately industrial, while areas to the north, south and east are <br />predominately residential. The area to the north and east of the site are subdivided and developed <br />residential areas are zoned for medium density and low density. To the west the property fronts the <br />Northwest Expressway, a minor arterial road, with a railroad and land zoned for heavy industrial use <br />further to the south. The industrial land is currently used for wood products storage. To the south is <br />Maxwell Road, also a minor arterial. South of Maxwell Road is a vacant area with wetlands owned by Lane <br />County and St. Peter Catholic School with residential areas to the south. The subject parcels surround a <br />property on the north, west and south sides that is developed with single family residence and zoned low <br />density residential. <br />For additional details of the requested zone change and site characteristics, please refer to the applicant's <br />written statement and other supporting application materials, as well as the following staff evaluation <br />and other attachments. <br />Application Referrals and Public Hearing Notice: <br />This zone change application was deemed complete on June 2, 2010. Staff provided information <br />concerning the application to other appropriate City departments, public agencies, and the affected <br />neighborhood group (River Road Community Organization) on June 4, 2010. Relevant referral comments <br />are incorporated into the following evaluation of compliance with the applicable zone change criteria. The <br />public hearing is scheduled for July 14, 2010. <br />Public notice of the zone change and hearing was mailed on June 14, 2010. Written testimony was <br />submitted by Marilyn Mohr, River Road Community Organization (RRCO) board member with concerns <br />regarding the siting of medium density residential;. Some of the concerns noted such as vision clearance <br />and pedestrian access are not related to zone change, but will be addressed in the associated tentative <br />subdivision application (City File ST 10 - * *). Concerns regarding the location of medium density <br />development as it relates to this proposal are addressed below as they relate to applicable policies at EC <br />9.8865(2). Any written testimony received after preparation of this report but prior to the public hearing <br />will be forwarded to the Hearings Official for consideration in making a decision. Public testimony, written <br />or otherwise, may also be presented at the public hearing and submitted into the record for this matter. <br />Staff Evaluation of Zone Change Request: <br />In accordance with EC 9.7330, the Hearings Official is required to approve, approve with conditions, or <br />deny this Type III land use application for a zone change. The decision must be based on, and be <br />accompanied by, findings that explain the criteria and standards considered relevant to the decision.
