EC 9.8865131: The uses and density that will be allowed by the proposed zoning in the <br />location of the proposed change can be served through the orderly extension of key <br />urban facilities and services. <br />Findings <br />The minimum level of key urban facilities and services are defined in the Metro Plan and <br />include wastewater service, stormwater service, transportation, solid waste management, <br />water service, fire and emergency medical services, police protection, City -wide parks and <br />recreation programs, electric service, land use controls, communication facilities, and public <br />schools on a district wide basis (Metro Plan page V -3). The applicant's findings related to EC <br />9.8865(3) (pages 1 -2 of the applicant's narrative) describe the availability of wastewater, <br />electricity, telephone, natural gas, and stormwater and are incorporated herein by reference. <br />Referral comments from Public Works staff indicate that transportation facilities and <br />wastewater facilities are currently available and that stormwater facilities can be made <br />available through off -site easements or on -site treatment. All other key urban services are <br />currently available to the subject property, or can be extended in an orderly and efficient <br />manner to the property as needed to serve development. <br />Ms. Mohr's testimony described the specific characteristics of the subject property and <br />surrounding neighborhood, which Ms. Mohr argues make the property not suitable for R -2 <br />zoning. For example, Ms. Mohr specifically mentioned vision clearance and pedestrian access. <br />These are factors that could be related to the availability of public facilities (EC 9.8865(3)), but <br />the code criterion does not require anything other than ensuring that public facilities are <br />available or can be made available to the subject property. Staff recommended and the <br />hearing official concurs based on the information in the record that there are or could be <br />adequate urban facilities. It is the tentative subdivision application that will address the specific <br />issues of how the subdivision would provide adequate vision clearance and pedestrian access. <br />Review of the subdivision application may conclude that the applicant would need to improve <br />pedestrian access or vision clearance due to impacts of the actual proposal. <br />Conclusion <br />Key urban facilities and services are currently available or can be extended in an orderly <br />manner to the subject property. The zone change request is consistent with this criterion. <br />EC 9.8865141: The proposed zone change is consistent with the applicable siting <br />requirements set out for the specific zone in: * * * <br />f) EC 9.2735 Residential Zone Siting Requirements. <br />Subsection (f) EC 9.2735 Residential Zone Siting Requirements includes requirements for R 1.5 <br />zoning.
