RRSC UFP Page 6 of 9
Land Use Decision Impact Analysis

“The current EC provides numerous provisions in the
general development standards to minimize conflicts. A
broad aspirational policy to minimize land use conflicts
does not require the imposition or retention of site review
as a general rule.” Findings page 4.
7.10.2017 Ord. 20583
RA 16-1
Santa Clara Station, approving text amendment to allow
transit facilities in the River Road/Division Subarea (site
located on the east side of River Road, north of Green
Lane and south of Hunsaker Lane):
“Given that the requested refinement plan amendment is
text only, the request does not affect the refinement plan’s
land use diagram or any of the subarea land use
diagrams. The requested addition to permitted land uses
– transit facilities- is normally permitted in the property’s
commercial designation.” Findings page 9.
6.23.2016
Withdrawn
MA 15-3
RA 15-2
Z 15-7

Brenelaine Inv., request to change from Commercial to
Medium Density Residential 17.5-acre site at Maxwell and
North Park. Public testimony opposed request since there
was no evidence of a substantial change in circumstance
since RRSC UFP was adopted and DLCD staff raised
concern regarding compliance with Statewide Goal 9.
Application withdrawn.
6.22.2016 PDT 16-1 McKenzie Living, approving a 58-bed assisted care facility
with findings demonstrating compliance with the RRSC
UFP. Staff report, pages 4-5.

6.1.2016
CU 16-1
SR 16-1
U Haul, approval of CUP and Site Review for outdoor
display and rental of large trucks for U-Haul self-storage
facility east of River Road on Oroyan Avenue:
“The property is located within the River Road/Wilkes
subarea.” Consistency with RRSC UFP policies provided
basis for conditions of approval to address compatibility.
Findings page 4.
11.25.2015 CU 14-4 Verizon Wireless at Neighborhood Assembly of God,
approval of a CUP for a 75-foot mono-pole pine tree cell
tower. Consistency with Metro Plan included review of
RRSC Plan Commercial and Industrial Land Use Policies
1.0 and 2.0. with finding: “Frankly, this is a very broad and
subjective plan provision, and it is difficult to apply to a
conditional use permit for a cell tower in an R-1 zone.” The
Metro Plan Policy E.4 required public and private facilities
to be designed to preserve and enhance desirable
features of the neighborehood. Finding stated, “There has
not been substantial discussion about what the “desirable
features” of the neighborhood are. . . I do not see that “the
absence of cell towers” is a desirable feature.” Findings
page 7.
30
