EC 9.8865(1) is satisfied. <br />EC 9.8865(2) <br />EC 9.8865(2) requires that the proposed zone change be consistent with the applicable <br />adopted refinement plans. The applicable refinement plan for the property is the River Road - <br />Santa Clara Urban Facilities Plan (Refinement Plan). The Refinement Plan designates the property <br />as Government & Education, which is consistent with the Metro Plan and its current use. While <br />there do not appear to be any directly applicable Refinement Plan policies, the staff report identifies <br />as generally applicable Land Use Element - Policy 1.0, which provides: <br />Minimize land use conflicts by promoting compatibility between land uses, especially <br />among residential, commercial-industrial, and commercial-agricultural uses." <br />Land Use Element - Policy 1.0 is a broad aspirational policy. The current EC provides <br />numerous provisions in the general development standards to minimize conflicts. A broad <br />aspirational policy to minimize land use conflicts does not require the imposition or retention of <br />site review as a general rule. There is nothing in the Refinement Plan that requires retention of the <br />SR overlay, and Land Use Element - Policy 1.0 is satisfied (to the extent it must be satisfied) by <br />the current general development standards. <br />Therefore, EC 9.8865(2) is satisfied. <br />EC 9.8865(3) <br />EC 9.8865(3) requires that the uses and densities allowed by the proposed zoning can be <br />served through the orderly extension of key urban facilities and services. Key urban facilities and <br />services are defined in the Metro Plan as: wastewater service, stormwater service, transportation, <br />water service, fire and emergency medical services, police protection, city-wide parks and <br />recreation programs, electric service, land use controls, communication facilities, and public <br />schools. The staff report explains that key urban facilities and services are available to the site. <br />Therefore, EC 9.8865(3) is satisfied. <br />EC 9.8865(4) <br />EC 9.8865(4) requires that the proposed zone change be consistent with certain applicable <br />siting requirements. In this case, EC 9.8865(4)(a) requires that the application be consistent with <br />the applicable siting requirements of -EC 9.2681 Public Land Zone Siting Requirements." EC <br />9.2681(2) provides that in addition to the zone change approval criteria of EC 9.8865 that "the <br />subject site must be land owned solely by a public agency or a non-profit organization * * The <br />owner of the property is Eugene School District 4J, which satisfies EC 9.2681(2). <br />Hearings Official Decision (Z 20-2) Page 4 <br />161
