That <br />would save a lot of time, expense, and litigation at LUBA. <br />LUBA on a regular basis has to make the final call what the plan designation is for a unit of land <br />in Eugene or where the plan boundary is. It has repeatedly asked, in the body of its opinions, <br />why it has to do that – why can’t Eugene adopt a plan diagram that is parcel specific, like all the <br />other cities manage to do? This Commission asks the same question from time to time. It is time <br />to ask it again, but not accept the “we are working on it” answer. Here is an example of how the <br />city is not working on it, but rather moving in the opposite direction. That is, the City is <br />abandoning a refinement plan map that, although not fully parcel specific has proven useful in <br />answering the recurring question in Eugene --“Hey, what is my property plan designated?” <br />From the standpoint of a practitioner, leaving the current refinement plan in place is far <br />preferrable to pitching it in favor of the current proposal. <br />Sincerely, <br />Bill Kloos <br />Bill Kloos <br />Cc: clients <br />12
