East 20th Avenue MHLD (MHT 23-4) Page 3 of 4 <br />Conditions of Approval <br />August 3, 2023 <br /> <br /> <br />Schirmer Consulting, LLC · PO Box 10424, Eugene, OR 97440 · (541) 234-5108 <br />Landscape Architecture + Land Use Planning <br />· The site plan illustrates a “Proposed 5 foot private utility easement” along the western portion of the <br />subject site and holds a wastewater line connecting East 20th Avenue to Middle Housing Lot (Parcel 2). <br />The design of the separate wastewater lines used to serve the proposed Middle Housing Lots may be <br />reconfigured to create a community sewer (i.e. a configuration in which one wastewater line is connected <br />to the East 20th Avenue main line and then divided to serve individual Middle Housing Lots). However, if a <br />Community Sewer is installed, an easement that defines access and maintenance responsibilities will be <br />required for the affected area in accordance with the Plumbing Code. <br />See attached draft Private Utility and Access Easement Agreement. <br /> <br />Final Site Plan and Performance Agreement Informational Items: <br />· In accordance with EC 9.7025, A Performance Agreement is required following the approval of a Middle <br />Housing Land Division. The Performance Agreement will include a “Final Plan Set” that includes relevant <br />notes, features, and information relevant to this decision. <br />See attached final Site Plan. <br /> <br />· Please amend the title block of the final version of the site plan to state “Middle Housing Land Division” in <br />place of “Tentative Partition Plan”. <br />See attached final Site Plan. <br /> <br />Electric Comments <br />EWEB has overhead electric facilities on the north side of East 19th Alley. The overhead electric service to the <br />existing outbuilding crosses over proposed parcel 2 for the benefit of parcel 1. In accordance with EWEB <br />policies and procedures, electric facilities extending across tax lots to serve adjacent properties will require <br />easement. Prior to or concurrent with recording the final plat, the applicant shall provide EWEB with a 5’ wide <br />EWEB Utility Easement centered on the overhead facility or contact EWEB to have the service removed or <br />relocated. <br />A 5’ wide PUE has been shown centered on the overhead powerline. <br /> <br />Electric comments or questions can be directed to : <br /> <br />Roxy Satterfield <br />Engineering Technician IV <br />Eugene Water & Electric Board <br />Office/fax 541-685-7166; roxy.satterfield@eweb.org <br /> <br />Water Comments <br />EWEB has no objections to the proposed property partition. The existing dwelling on parcel 1 is currently <br />served. There is a 4” water main on the north side of E. 20th Ave to provide a new service for parcel 2. <br /> <br />EWEB Water recommends the developer contact the Fire Marshall concerning fire protection requirements for <br />building permits. <br /> <br />EWEB water does not allow installation of any water facilities under proposed “rain gardens” or any open <br />drainage structure within the right-of-way. Provisions within the design must be made to accommodate the <br />installation of water facilities (services & hydrants) at common lot corners. A minimum 5’ wide “utility corridor” <br />at service crossing and hydrant locations is required. State Drinking Water regulations (OAR 333-061- <br />0050(10)) require a minimum separation between water and sewer lines of 10’ where they run parallel to each <br />other, unless the sewer line is located with 1.5’ of clearance lower than the water line then the required <br />separation is 5’. EWEB owned water facilities will be located in the right-of-way, or in a minimum 7’ public utility <br />easement (PUE) adjacent to the public right-of-way. <br /> <br /> <br /> <br /> <br /> <br />
