\•fir' <br />qwPlanning Commission <br />NOTICE OF PUBLIC HEARING <br />Tuesday, August 15, 2023, 5:30 p.m. <br />Virtual Meeting (See attendance information on last page) <br />The Eugene Planning Commission will hold a virtual public hearing to consider: <br />File Name (#): Skinner Butte/Downtown Riverfront Height Code Amendment (CA 23-2) <br />Request: An amendment to Eugene's Land Use Code (Chapter 9) to allow for an increase in <br />allowable building height for a specific property zoned S -DR Downtown Riverfront <br />Special Area Zone and subject to the Skinner Butte Height Limitation Area. <br />The proposed amendment is intended to facilitate development opportunities for <br />a property in the downtown area and will result in updates to Figure 9.6715(3) of <br />the Skinner Butte Height Limitation Area and Figure 9.3155(3)(a) of the S -DR <br />zone. The property currently has a building height limitation of 500 feet above <br />mean sea level. The amendment would allow for buildings up to 530 feet above <br />mean sea level to be constructed. If approved, this allowance would result in an <br />increase in potential building height from approximately 70 feet to approximately <br />100 feet in height for a single property. <br />Location: Southeast corner of High Street and East 41h Avenue (Tax lot 14200 of Assessor's <br />Map 17-03-31-11) <br />Property Owner: Urban Renewal Agency of the City of Eugene <br />Procedures & Approval Criteria <br />This land use code amendment will be processed using the Type IV land use application procedures in <br />Eugene Code (EC) 9.7400-9.7455. Following this initial public hearing, the Planning Commission will <br />deliberate and make a recommendation to the City Council. The City Council will hold a second public <br />hearing, then deliberate and make the final decision on the proposed land use code amendment. The City <br />Council will be the final local decision -maker on the application. Separate notice of the City Council public <br />hearing will be provided. In making a recommendation on these proposed code amendments to the City <br />Council, the Planning Commission will address the relevant approval criteria from EC 9.8065. <br />Testimony and evidence submitted should be directed toward the applicable approval criteria from the <br />Eugene Code noted above, other criteria in the City's adopted plans or land use regulations, or applicable <br />state law that the person testifying believes to apply to the decision. Issues which may provide the basis <br />for an appeal to the Land Use Board of Appeals must be raised in writing with sufficient specificity to <br />enable the decision maker to respond to the issues prior to the expiration of the comment period. <br />
