Attachment 1 <br />so that Willamette River Greenway Permits reviewed under the new clear and objective approval criteria would <br />be processed as Type II land use applications and would not require an initial public hearing. <br />In response to public input and Planning Commission direction, the initially proposed Type II "Design Plan and <br />administrative review" process for clear and objective track applications has been removed from the Willamette <br />River Greenway Code Amendments. The amendments maintain the City's existing requirement for a public <br />hearing on all Willamette River Greenway Permits, including permits reviewed under the new clear and <br />objective approval criteria as part of the Type III land use application procedures, thereby eliminating the need <br />for approval of a "Design Plan" as that term is used in Goal 15. Nonetheless, the draft Design Plan' created in <br />support of the initially proposed Willamette River Greenway Code Amendments includes a variety of useful <br />information and evidence that supports the City Council's findings that the Willamette Greenway Code <br />Amendments meet the approval criteria in EC 9.8065. While the City Council does not adopt the Design Plan in <br />its entirety, certain of the City Council's findings do adopt and incorporate specific information and evidence <br />included in the Design Plan attached as Exhibit A to these findings. <br />Findings of Compliance with Approval Criteria <br />As the following findings establish, the Willamette River Greenway Code Amendments (CA 22-1) are consistent <br />with the applicable approval criteria for code amendments, and specifically meet or exceed the requirements of <br />Statewide Planning Goal 15. The new clear and objective approval criteria for development of housing within <br />the Greenway will ensure that by complying with the adopted clear and objective Greenway standards, <br />applicants proposing intensification of housing uses, change of use to housing, or development of proposed <br />housing within the Greenway will comply with the requirements of Goal 15 for: maximum possible landscaped <br />area, open space, or vegetation between the activity and the river; and, necessary public access to and along the <br />river by appropriate legal means. <br />Eugene Code (EC) Section 9.8065 requires compliance with the following approval criteria (listed in bold and <br />italic), for a land use code amendment.: <br />EC 9.8065(1): [The amendments are] consistent with applicable Statewide Planning Goals as adopted <br />by the Land Conservation and Development Commission. <br />As expressed in more detail in the findings of compliance with each of the Statewide Planning Goals 1 through <br />19 below, the City Council finds that the Willamette Greenway Code Amendments are consistent with applicable <br />Statewide Planning Goals and this criterion is satisfied. <br />Goal 1 Citizen Involvement. To develop a citizen involvement program that insures the <br />opportunity for citizens to be involved in all phases of the planning process. <br />The City's acknowledged procedures for adoption of legislative land use decisions, located in EC 9.7050 and <br />9.7500 through 9.7560, ensure the opportunity for community members to be involved in all phases of the <br />legislative land use decision process and set out the requirements for such involvement. The Willamette River <br />Greenway Code Amendments do not amend or change the City's adopted citizen involvement program.
