Draft Findings & Updated Draft Code <br />Following the Planning's Commission's last deliberations meeting, which was focused on <br />remaining key topic areas and finalizing the updated draft code, staff has prepared a set of draft <br />legislative findings in support of the proposed Willamette River Greenway Code Amendments. <br />These draft findings are necessary as part of the approval process by demonstrating how these <br />changes to the City's land use code will comply with the approval criteria for code amendments <br />at Eugene Code (EC) 9.8065. <br />The draft findings were provided to Commissioners for initial review via email in advance of the <br />meeting on March 10, 2023 and are included as Attachment 1, for ease of reference. With the <br />final few details addressed during the last deliberations meeting on these code amendments, <br />staff has also prepared an updated version of the draft code, which was also sent via email and <br />included as Attachment 2. The updated draft code includes final revisions to the public <br />accessway standard at EC 9.8812(4)(a)2., as well as a few minor updates to the code's <br />procedural requirements for noticing of Willamette River Greenway Permits. These minor <br />procedural changes were discovered by staff as being necessary in developing the draft findings, <br />upon a closer review of the specific noticing requirements under Goal 15. <br />The updated draft code and findings in support of the proposed Willamette River Greenway <br />Code Amendments will be the focus of final deliberations and remaining discussion as needed <br />for the Planning Commission to reach its recommendation to City Council. At this meeting, staff <br />will briefly touch on the last few draft code revisions noted above along with related mapping <br />updates and provide opportunity for discussion of the draft findings as needed to facilitate the <br />Commission's final recommendation. <br />The related Greenway Web Map on the City's website has been updated with a new measuring <br />tool and revised layers showing public access points and tax lots subject to the public accessway <br />standards, as well as the proposed tree preservation zones and the proposed Willamette River <br />top of bank and Greenway setback locations. This detailed map, as referenced in the draft code <br />and findings, includes the draft GIS mapping layers and underlying source data intended for <br />adoption as part of the proposed amendments. <br />PROCEDURAL SUMMARY <br />As noted in prior materials for this project, the proposed land use code amendments are <br />subject to Type V application (legislative) procedures (EC 9.7500 through EC 9.7560), as well as <br />the approval criteria in EC 9.8065. <br />Notice of both prior public hearings on these code amendments was provided consistent with <br />the notice requirements for Type V (legislative) land use applications. All written testimony <br />received through the date of the second public hearing and open record period ending on <br />January 20, 2023 has been provided to the Planning Commission for consideration. All <br />testimony submitted to the Planning Commission, including any testimony submitted after the <br />end of the Planning Commission's open record period, will also be forwarded to the City Council <br />for consideration as part of their subsequent public hearing process. <br />As a courtesy, written testimony received by the City, along with a variety of additional <br />materials including the online Greenway Web Map, prior meeting materials and recordings, and <br />Page 4 of 125 <br />
