Attachment 1 <br />Willamette River Greenway Permit applicant will provide the maximum possible landscaped area, open space or <br />vegetation between the activity and the river, while still allowing intensifications of use, changes in use, and <br />development within the Willamette River Greenway as contemplated by Goal 15. The City Council therefore <br />finds that Willamette River Greenway Code Amendments are consistent with this implementation measure. <br />(2) Necessary public access will be provided to and along the river by appropriate legal means, <br />The City Council finds that significant public access to and along the Willamette River has been provided over <br />the years, consistent with Goal 15. Specifically, the City Council finds there are ten City-owned parks and two <br />community centers open to the public located within the Willamette River Greenway. The City Council <br />further finds that 782 acres of land within the Greenway are owned by the City as public land and used for <br />park purposes. Finally, the City Council finds that there are 25.8 miles of bike paths open to the public within <br />Eugene's portion of the Willamette Greenway.4 The City Council also adopts and incorporates the map titled <br />"Willamette Greenway Public Access Points," into the Council's findings regarding public access to and along <br />the Willamette River (see Attachment B). This map shows public access points to and within the Willamette <br />River Greenway and will be included on digitized maps be adopted as Exhibit to the Willamette <br />Greenway Code Amendments. The public access points shown on the map include mapped points where <br />public right-of-way and multi-use paths intersect with existing path connections within (or at the edge of) the <br />Willamette River Greenway, that lead to the Willamette River. A more detailed description of the <br />methodology to determine these points and the related walkability analysis conducted to create and refine <br />the map is included in the record for these amendments. Consequently, the City Council finds that significant <br />public access to and along the Willamette River already exists. <br />In addition to the existing public access, the clear and objective approval criteria in the Willamette River <br />Greenway Code Amendments apply the following access requirements to development that will result in five <br />or more dwelling units on one development site: (1) if the development site abuts publicly owned land, three <br />foot wide, on-site pedestrian paths must be provided from the property line nearest the Willamette River to <br />main building entrances; and/or (2) if the development site is located more than 500 feet from a public <br />access point shown on the map titled "Willamette Greenway Public Access Points" as noted above, the City <br />will require the dedication and improvement of a public accessway, extending to existing public ways that <br />provide a connection to or along the Willamette River, provided the City can make the required <br />constitutional findings. <br />For all the reasons listed above, the City Council finds the existing public access to and along the Willamette <br />River, as well as the clear and objective approval criteria related to access included in the Willamette River <br />Greenway Code Amendments, will ensure that, to the greatest possible degree, an intensification, change of <br />use, or development proposed by a Willamette River Greenway Permit applicant will provide necessary public <br />access to and along the river, while still allowing intensifications of use, changes in use, and development within <br />the Willamette Greenway as contemplated by Goal 15. The City Council finds that Willamette River Greenway <br />Code Amendments are consistent with this implementation measure. <br />c.
