Acquisition Areas: Each comprehensive plan shall designate areas identified for possible public <br />acquisition and the conditions under which such acquisition may occur as set forth in the approved DOT <br />Willamette Greenway Plan and any other area which the city or county intends to acquire. <br />Element D of the Metro Plan, the "Willamette River Greenway, River Corridors, and Waterways Element," <br />generally acknowledges that land within the Greenway may be acquired for park use. Nothing in the Willamette <br />River Greenway Code Amendments changes or amends the Metro Plan. <br />OAR 660-015-0005 F. sets out the following requirements in the form of implementation measures to be achieved <br />through cooperative efforts of State and local governments, consistent with Statewide Planning Goal 15, state <br />statutes, and local governments' comprehensive plans. These measures include: <br />• Boundaries: Establishment of a Willamette River Greenway boundary on zoning maps and referred to in <br />zoning and subdivision ordinances. <br />Uses: Management of uses within the Greenway including use management considerations and <br />requirements required by section C3 of Goal 15. <br />Greenway Compatibility Review: Establishment of provisions by ordinance for the review of <br />intensifications, changes in use, or developments to ensure compatibility with the Willamette Greenway. <br />Each of these topic areas are addressed with additional findings below: <br />F.1. Boundaries: Willamette River Greenway boundaries shall be shown on city and county zoning maps <br />and referred to in the zoning ordinance and the subdivision ordinance. <br />In 1976, the City of Eugene approved Resolution No. 2592 which included the establishment of a Willamette <br />River Greenway boundary and identification of potential acquisition sites. In Eugene, the officially recognized <br />Greenway boundary is the boundary adopted by Resolution No. 2592, however these Greenway boundaries <br />have also been digitized in the Regional Land Information Database (RLID) and are shown as a layer that can be <br />viewed on the Eugene Zoning Map, available on the City's website. The City Council finds that Chapter 9 of the <br />Eugene Code constitutes the City's "zoning ordinance" and "subdivision ordinance" as those terms are used in <br />Goal 15. EC 9.8805 provides that Willamette Greenway Permits are required for all "intensifications of uses, <br />changes in use, or developments within the boundaries of the Willamette River Greenway established by <br />Resolution No. 2592;" therefore, the City Council finds that the Willamette River Greenway boundaries are <br />shown on the City zoning map and referred to in the City's zoning and subdivision ordinance as required. <br />F.2. Uses: Measures for managing uses within the Greenway shall include at least: <br />a. Exclusive farm use zoning of all agricultural land within and adjacent to the Greenway; <br />The Willamette River Greenway Code Amendments do not rezone or re-designate any lands designated or <br />zoned for exclusive farm use zoning or other agricultural uses. The Code Amendments only impact urban lands <br />within the portion of the Willamette River Greenway located within the City of Eugene. <br />b. Floodplain zoning of all areas subject to flooding, <br />The City's floodplain regulations stem from Federal Emergency Management Agency (FEMA) requirements as <br />administered by local agencies. The City requires a floodplain development permit for all development within <br />the floodplain, which is administered through building permit review and is not a land use decision, however <br />development within the Willamette River Greenway and /WR conservation areas require land use review and <br />approval, if permitted according to those separately applicable approval criteria for Willamette River Greenway <br />Page 17 of 125 12 <br />
