• Reduce barriers to housing development; <br />• Meet the City's obligations under State law; and <br />• Maintain a balanced approach to protecting the Willamette River Greenway with <br />effective development standards. <br />In response to public input received during and after the first Planning Commission public <br />hearing on March 8, 2022, as well as Planning Commission deliberations and direction at the <br />June 14, 2022 and August 2, 2022 Planning Commission meetings, staff has updated the <br />proposed Willamette River Greenway Code Amendments. Below is a summary of the proposed <br />amendments, followed by a more detailed overview of the updates made to the proposal since <br />the initial public hearing. <br />Summary of Proposed Willamette River Greenway Permit Approval Criteria & Procedures <br />• The updated Willamette River Greenway Code Amendments add clear and objective <br />approval criteria for development of housing within the boundary of the Willamette River <br />Greenway. An applicant proposing housing may choose to proceed under the clear and <br />objective standards (Clear and Objective Track) or the discretionary standards <br />(Discretionary Track). The clear and objective standards include the following: <br />o Establishment of a 100-foot setback from the river for new housing (the Greenway <br />Setback); <br />o A map of the Greenway Setback; <br />o A map showing public access points; <br />o Limitations on building fagade length within 100 feet of the Greenway Setback; <br />o Limitations on walls and fencing within and near the Greenway Setback; <br />o Pedestrian access requirements for multi-unit developments; <br />o Native landscape buffer requirements; and <br />o Tree preservation and removal requirements. <br />• The updated Willamette River Greenway Code Amendments also add tree preservation and <br />removal requirements to the existing discretionary approval criteria for Willamette River <br />Greenway permits. <br />Updates Since the March 8, 2022 Public Hearing <br />The following changes have been made to proposed Willamette River Greenway Code <br />Amendments since the March 8, 2022, Planning Commission public hearing: <br />• The addition of tree preservation and removal standards to both the proposed clear and <br />objective approval criteria (Clear and Objective Track) and the existing discretionary <br />approval criteria (Discretionary Track) for Willamette River Greenway Permits, to enhance <br />the protections applied to new development within the Greenway. See Attachment B for <br />more details. <br />• The proposed Willamette Greenway Code Amendments now provide that all Willamette <br />Greenway Permit applications, whether subject to the approval criteria in the Clear and <br />Objective Track or the Discretionary Track, will undergo a Type III process, which consists of <br />Page 4 of 39 <br />
