Approval Criteria - Zone Change Supporting Facts and Findings <br />This section is organized by the applicable approval criteria per EC 9.8865. Applicable approval criteria <br />are outlined in bold italics below, followed by proposed findings in normal text. <br />EC 9.1060 - Changes In Zone Boundaries And Overlay Zone Boundaries. <br />Unless automatically changed upon annexation pursuant to EC 9.7820, Changes in zone <br />boundaries or overlay zone boundaries shall be processed pursuant to the Type 111 <br />Application Procedures (EC 9.7300 - 9.7340) or, if processed concurrently with a refinement <br />plan or code amendment, Type IV Application Procedures (EC 9.7400 - 9.7455). Decisions <br />shall be based on the criteria contained in EC 9.8865 Zone Change Approval Criteria <br />Finding: As stated above, the Metro Plan Diagram designates the subject property LDR. The River Road- <br />Santa Clara Urban Facilities Plan Land Use Diagram also designates the site LDR. The zone was <br />automatically changed upon annexation from R-1/UL to R-1. The proposed zone change from R-1 to PL <br />remains consistent with the LDR designation in the adopted plans, and no concurrent plan or code <br />amendments are proposed. Therefore, the subject application shall be processed as a Type III <br />application and shall address the criteria in EC 9.8865. <br />EC 9.8865 - Zone Change Approval Criteria. <br />Approval of a Zone Change application, including the designation of an overlay zone, shall <br />not be approved unless it meets all of the following criteria: <br />(1) The proposed change is consistent with applicable provisions of the Metro Plan. The <br />written text of the Metro Plan shall take precedence over the Metro Plan diagram where <br />apparent conflicts or inconsistencies exist. <br />Finding: The Metro Plan is the guiding policy document for the Eugene-Springfield Metropolitan Area. <br />Under state law all implementing ordinances and regulations, including the Eugene Zoning Code, must <br />be consistent with the Metro Plan. The adopted Metro Plan Diagram designates the site as LDR. Per <br />Section II-G Metro Plan Diagram findings, the community recognizes that "approximately 32-percent of <br />the area is available for auxiliary uses" including streets, parks, or schools. The Residential designation <br />description states that "[s]uch auxiliary uses shall be allowed within residential designations if compatible <br />with refinement plans, zoning ordinances, and other local controls for allowed uses in residential <br />neighborhoods." This directive applies to all residential plan designations. The PL zone regularly <br />implements the Residential designation when applied to neighborhood schools across the city. <br />The auxiliary use finding is also incorporated into the Metropolitan Residential Land Use and Housing <br />Element findings. <br />1 8 .
