DRAFT WILLAMETTE RIVER GREENWAY DESIGN PLAN <br />1.2 WILLAMETTE RIVER GREENWAY GUIDELINES <br />OAR 660-015-0005 F. sets out implementation measures to be achieved through cooperative efforts of state <br />and local governments, consistent with the Goal, statutes, and comprehensive plans. These measures <br />include: <br />• Boundaries: Establishment of a Willamette River Greenway boundary on zoning maps and referred to <br />in zoning and subdivision ordinances. <br />• Uses: Management of uses within the Greenway including use management considerations and <br />requirements. <br />• Compatibility Review: Establishment of provisions by ordinance for the review of intensifications, <br />changes, use, or developments to ensure compatibility with the Greenway. <br />Resolution No. 2592, approved in 1976, included boundaries of the Willamette River Greenway for areas <br />within the city limits, as shown on maps attached to the resolution. The Greenway boundaries have been <br />digitized in the Regional Land Information Database (RLID) and are shown as an overlay on the Metro <br />Plan Diagram. Management of uses and compatibility review is accomplished by Ordinances No. 20224, <br />20513, and 20569, which established code provisions including the Willamette Greenway Permit application <br />process, which is required for intensification of uses, changes in use, or development within the Greenway <br />boundaries. <br />As part of compatibility review, ordinances are required to include the following provisions as specified in <br />3(a) through (e) of paragraph F: <br />• Boundaries adjacent to the river within which development is reviewed. <br />• Approval criteria directed at ensuring that appearance, landscaping, and public access are considered <br />to the greatest possible degree. <br />• Public hearing. <br />• Noticing to owners of contiguous property and to other interested parties. <br />• Allowance for imposing conditions on the permit to carry out the purpose and intent of the Greenway <br />statutes <br />The Willamette Greenway provisions currently in the Eugene Code at 9.8800-9.8825 comply with these <br />requirements. <br />Goal 15 also provides for an alternative review procedure that allows cities to prepare and adopt a design <br />plan and administrative review procedure for development within the Greenway. The design plan must <br />provide findings under the following criteria, set out in sections 3(b)(1) and (2) of paragraph F of Goal 15: <br />[T]o the greatest possible degree: <br />• The intensification, change of use, or development will provide the maximum possible landscaped area, <br />open space, or vegetation between the activity and the river. <br />• Necessary public access will be provided to and along the river by appropriate legal means. <br />This Design Plan and concurrently adopted administrative review procedure comply with these <br />requirements and allow for the adoption of clear and objective approval criteria for development of <br /> - Page 44 of 91 <br />WILLAMETTE RIVER GREENWAY CODE AMENDMENTS <br />
