If there is no EC 9.8030 subsection that pertains to the type of standard being considered, <br />adjustment may be permitted based solely on compliance with EC 9.8030(18)(a). <br /> <br />The purpose statements from the S-CN zone at EC 9.3100 that relate to the standard in question focus <br />on the visibility of entrances from the public way. The applicant’s proposal for a segmented façade and <br />lawn will provide visual cues and visibility of the building when viewed from the street. Their site plans <br />also show a wide section of sidewalk on the northern portion of their lot near a main building entrance <br />which will provide an unobstructed view of the entrance from the public way. The second part of the <br />above approval criteria reference other applicable adjustment criteria. The other applicable criteria for <br />adjustment are provided by EC 9.8030(2) and as discussed above, have been found to be met. <br /> <br />Based on the available information, an adjustment to the standard provided by EC Table 9.3125(3)(g) S- <br />CN Chase Garden Node with relation to buildings fronting a street is met. <br /> <br />Adjustment Request 4 – EC 9.5500(6)(a) <br /> <br />EC 9.5500(6): Building Mass and Facade. <br />(a) Maximum Building Dimension. Neither the maximum length nor width of any building <br />within 40 feet of a front lot line can exceed 100 feet in the R-1 and R-2 zones and 150 feet <br />in all other zones. <br /> <br />The applicant’s proposed building is approximately 197 feet in length along Garden Way, which exceeds <br />the 150-foot building length maximum provided above. <br /> <br />EC 9.8030(8) Multiple-Family Standards Adjustment. Where this land use code provides <br />that the multiple-family standards may be adjusted, the standards may be adjusted upon <br />finding that the design achieves all of the following: <br />(a) Maximum Building Dimension. The requirements set forth in EC 9.5500(6)(a) may <br />be adjusted if the proposal creates building massing and/or facades that: <br />1. Create a vibrant street facade with visual detail. <br />2. Provide multiple entrances to building or yards. <br /> <br />The applicant states that the proposed building incorporates articulation using bays, balconies, changes <br />in materials, canopies, and varied window fenestration. Additionally, the mass of the building will be <br />broken into two major subcomponents that will be 115 feet and 57 feet in length using a recess in the <br />façade, a change in roof type and orientation, and building mass orientation. The applicant has also <br />proposed landscaping, and patio entries and units to further break up the mass of the building. <br />Based on the available information, the applicant’s request for adjustment to EC 9.5500(6) is approved. <br /> <br />Adjustment Request 5 – EC 9.5500(8) <br /> <br />EC 9.5500(8) Site Landscaping. <br />(c) Landscape Requirements. Site landscaping shall conform to the following: <br />1. Required Landscaping in Yards Abutting Streets. Landscaping shall be installed <br />and maintained in yards abutting streets that complies, at a minimum, with the <br />Attachment A
