l <br />3.Partnering with Eugene City Parks <br />Appellants Argument <br />The Harlow Neighbors state that in the Chase Gardens Nodal Development Plan, Chase Commons City <br />Park is connected by a Foot/Bike Bridge to the applicant's site over the Q Street Floodway. The Harlow <br />Neighbors request that the Historic Review Board and City Public Works/Parks address this with a <br />condition of approval. <br />Planning Commission's Determination <br />The Historic Review Board was required to review the applicant's request as submitted and under <br />specific approval criteria and factors from the Eugene Code and the relevant OAR. While the idea of <br />partnership and additional design process are certainly understandable aspirations, the Board did not <br />have the authority to require the applicant to enter into partnerships or undertake additional process. <br />The Board was obligated to act in accordance with the timeline for a decision provided by EC 9.7330, <br />and within the authority of the applicable approval criteria. In addition, as noted previously with respect <br />to the Baker appeal under Factor 6, the idea of a land swap or some other partnership was not raised <br />before the Historic Review Board making it a new issue that cannot be relied upon in finding error with <br />the Board's decision on appeal. The Planning Commission finds that this appeal issue does not provided <br />a basis for reversal or modification of the Historic Review Board's decision. <br />V.CONCLUSION <br />The Planning Commission has reviewed the record and has voted affirm the decision of the Historic <br />Review Board, the Final Order of which is incorporated by reference and included as Attachment A. <br />The foregoing findings and conclusions are adopted as the Final Order of the Eugene Planning <br />Commission, for The Harry and Etta Chase House (HOM 21-1/ HA 21-3/ ARB 21-2}, this 17 th day of May <br />2022. <br />Ken Beeson, Chair <br />Eugene Planning Commission <br />Final Order: The Harry and Etta Chase House I HDM 21-1/ HA 21-3/ ARB 21-2
