c. Development of the Property and any Development Activities will comply with <br />the approved final site plans included as Exhibit "B" to this Agreement and the <br />following conditions of approval included in the Planning Director's decision <br />dated September May 19, 2021 approving Developer's subdivision application: <br />i. Prior to final plat approval, the following note shall be added to the final <br />site plan: "All lots are rowhouse lots and will be developed with <br />rowhouses." <br />ii. The applicant shall create an access restriction strip on the final plat that <br />runs along the easterly boundary line of Lots 7-9 where they abut <br />Amazon Parkway. This access restriction strip shall also be shown on the <br />related final site plan. <br />iii. Prior to final plat approval, the applicant shall update the final site plan <br />and plat to show the street name Amazon Parkway where it abuts the <br />subject property. <br />iv. Prior to final plat approval, the applicant shall submit a Private Joint Use <br />Access and Utility Easement and Maintenance Agreement (JAM). The <br />JAM will include a description defining the area of the private street and <br />will also identify permitted improvements, construction expectations, <br />rights of usage and maintenance responsibilities for the facilities in the <br />street. The JAM will be recorded concurrent with and cross-referenced <br />on the final plat. <br />v. Prior to final plat approval, provisions for a public emergency access <br />easement shall be provided. The public emergency access easement may <br />be within the private street and may be included in the proposed JAM <br />which creates the private street; or may be dedicated as a Public <br />Emergency Access Easement on a standard City form. <br />vi. Prior to final plat approval, the applicant shall provide documentation <br />that EWEB has received a financial guarantee, ensuring water will be <br />provided to each lot in the plat. <br />vii. Prior to final plat approval, the applicant shall submit an irrevocable <br />Petition for public improvements in Amazon Parkway to include street <br />trees. <br />viii. Prior to final plat approval, the applicant shall submit a statement <br />agreeing to develop in accordance with the recommendations of the <br />report dated March 4, 2021, provided by Troy Hull P.E., G.E. of Earth <br />Engineers, Inc., in accordance with EC 9.6710(6)(b). This required <br />statement shall also be noted on the applicant's final site plan. <br />ix. Prior to the removal of any street trees, the applicant shall obtain a <br />permit as required by EC 6.305. <br />2. Signs: All permanent signs associated with the Development Activities shall conform to <br />the applicable provisions of the Eugene Code. <br />3. Financing: Developer agrees, upon request of the City, to provide to the Building <br />Division the name and address of Developer, together with the designation of a <br />particular responsible official and any lending institution participating in the <br />Page 2 of 4 <br />
