Any easements required to <br />accommodate connection to the existing stormwater management facilities in <br />Brackenfern Rd. will be provided. These standards have been or can be met. <br />9.6797 Stormwater Operation and Maintenance. <br />(1) All stormwater facilities shall be operated and maintained in accordance with <br />EC Chapters 6 and 7, and the Stormwater Management Manual. <br />(2) Unless the applicant proposes private maintenance of the facility, a <br />stormwater facility that will provide treatment for runoff from the public right- <br />of-way shall be: <br />(a) Designed and constructed through the Privately Engineered Public <br />Improvement (PEPI) process; and <br />(b) Located in public rights of way or public easements dedicated in <br />accordance with EC 9.6796; and <br />(c) Selected from the list of stormwater facilities identified in the <br />Stormwater Management Manual as a type of facility that the City <br />will operate and maintain. <br />Response: The Applicant intends to operate and maintain the planned stormwater facilities, shown <br />on the Preliminary Composite Utility Plan in Exhibit A, in accordance with the Stormwater <br />Management Manual. Refer to the Preliminary Stormwater Report in Exhibit F for more <br />information. The responsibilities for operating and maintaining the private facilities will <br />be addressed through either updated covenants, conditions, and restrictions (CC&Rs) or <br />a separate maintenance agreement to be recorded against the lots and run with the dirt. <br />These standards can be met. <br />Standards for Streets, Alleys, and Other Public Ways <br />9.6805 Dedication of Public Ways. As a condition of any development, the city may require <br />dedication of public ways for bicycle and/or pedestrian use as well as for streets and <br />alleys, provided the city makes findings to demonstrate consistency with <br />constitutional requirements. Public ways for pedestrian and bicycle accessways, <br />streets and alleys to be dedicated to the public by the applicant shall conform with the <br />adopted Street Right of way Map, and EC Table 9.6870. <br />Response: The project will connect to Deerfern Road, which will be constructed as part of the East <br />Highlands Subdivision as shown in Exhibit A. The necessary public right-of-way to <br />accommodate Deerfern Road will be dedicated as part of the East Highlands Plat. The <br />proposed private road to serve the project will be dedicated in a private lot to serve the <br />future residents of Lot 1-9, and to be owned and maintained by the East Highlands HOA. <br />This standard can be met. <br />9.6810 Block Length. Block length for local streets shall not exceed 600 feet, unless an <br />exception is granted based on one or more of the following: <br />(1) Physical conditions preclude a block length 600 feet or less.
