The following submittal addresses all relevant Criteria for Vacation of Improved Easements from <br />the Eugene Code for review and approval of the requested vacation. The applicable criteria found <br />in the Eugene Code provisions are in bold format while statements demonstrating conformance <br />with the criteria follow in plain text format. <br />Eugene Code 9.8720 Approval Criteria for Vacation of Improved Easements: <br />The planning director shall approve, approve with conditions, or deny the vacation <br />application. The application shall be approved if the vacation is found to be consistent with <br />all of the following criteria: <br />(1) The subject area is not presently or in the future needed for public services, facilities, <br />or utilities, and the vacation does not prevent the extension of, or the retention of <br />public services, facilities, or utilities; or if needed, the applicant shall provide for the <br />replacement and abandonment of any existing public services, facilities, or utilities <br />in the subject area. <br />The easement is not presently, or in the future, needed for public services, facilities, or utilities; <br />and the vacation does not prevent the extension of, or the retention of public services, facilities, <br />or utilities. <br />(2) Such public services, facilities, or utilities can be extended in an orderly and efficient <br />manner in an alternate location. <br />All existing and proposed utilities either lie within, or will be constructed within, the Right-of-Way <br />dedications that were conveyed on the plat of Town Run, or within existing public easements. <br />(3) The vacation does not impede the future best use of the remainder of the property <br />under the same ownership or any adjoining land; or adversely affect the development of <br />the remainder land, or any adjoining land, or access thereto; and the vacation does not <br />conflict with provisions of this land use code including the street connectivity standards <br />and block lengths. <br />The vacation does not impede the future best use of the remainder of the property under the same <br />ownership or any adjoining land; or adversely affect the development of the remainder land, or <br />any adjoining land, or access thereto; and the vacation does not conflict with provisions of this <br />land use code including the street connectivity standards and block lengths. <br />(4) Payment of the special benefit assessment(s) resulting from the vacation of <br />unimproved right-of-way required by EC 9.8710(5)(a), have been made to the city. <br />Not applicable as this is not a vacation of a public right-of-way or public way. <br />Vacation of Mill Race Easement Criteria Statement Page 2 of 2 <br />(Book 340, Pages 163-171) <br />
