to the south, street improvements in Slocum Drive as dedicated on the final <br />partition plat shall include a minimum of twenty feet of paved surface. <br />C. The owner of Parcel 1 shall provide any dedication or public right-of-way that may <br />be necessary to construct a half street improvement along the south boundary of <br />Parcel 1. <br />D. Construction of street improvements on either Parcel 1 or Parcel 2 shall include <br />any waste water or storm water pipes necessary under paved surfaces to provide <br />services to Parcel 1, if service has not earlier been provided. <br />4. Storm Water Drainage <br />A. Paddock shall have the responsibility to the owner of Parcel 1 to provide <br />temporary or permanent public drainage easements and temporary construction <br />easements within Parcel 2 as may be necessary to complete the approved public <br />improvements in Parcel 1, or as otherwise necessary for the development of Parcel <br />1. <br />B. If storm drainage facilities are constructed on Parcel 2 prior to development of <br />Parcel 1, said facilities shall have sufficient capacity to handle storm water run-off <br />from Parcel 1, unless an alternative means is approved by the City engineer for <br />provision of storm water drainage for Parcel 1. <br />5. Waste Water <br />A. At the time of development of Parcel 1, Paddock will provide a temporary <br />construction easement adjacent to the public easements along the south boundary <br />of Parcel 2 of a sufficient width to allow the location and construction of waste <br />water sewer to connect Parcel 1 to the existing waste water sewer adjacent to the <br />east boundary of Parcel 2. <br />6. City's Advance Development of Parcel 1. In the event that the City's development of <br />Parcel 1 precedes or is in advance of Paddock's development of the remainder of the <br />Paddock Willow Creek Property, such advanced development by the City of Parcel 1 shall <br />not advance or accelerate Paddock's required public improvements to Paddock's <br />remaining Willow Creek Property. In such event, Paddock's responsibility for <br />construction of public improvements within Parcel 1 or adjacent thereto shall be limited to <br />providing necessary permanent or temporary public drainage easements and temporary <br />construction easements within adjoining Parcel 2 of Paddock major partition. <br />7. Final Plat. This Public Improvement Construction Agreement shall be noted as a <br />reference to Paddocks final plat for the major partition. <br />Page 2 <br />
