2. To be counted toward the minimum required, private open space may be <br />covered, but cannot be enclosed. Private open space is considered enclosed <br />when the space between a floor, decking, or ground level and a roof structure <br />has more than three sides taller than 42 inches in height. <br />3. Ground level private open space shall be screened or buffered from <br />adjacent private open space and dwellings by landscape, fencing or partitions. <br />Such screening or buffering shall be a minimum of 30 inches in height. <br />4. Ground level private open space shall be physically separated from <br />common outdoor open space by fencing or landscaping meeting the EC <br />9.6210(2) Low Screen Landscape Standard (L-2). <br />Based on the applicant's narrative and building floor plans, each unit will have private open <br />space as required by code. Ground floor units will have patio areas that are 100 square feet <br />(100 square feet required) in size. It appears that all second and third story units will have <br />balconies that range in size from 48 to 60 square feet in size, complying with this standard. The <br />applicant states that all ground level private open space will be screened in accordance with <br />these standards. However, the applicant's landscape plan and site plans do not provide <br />sufficient evidence to demonstrate compliance with these standards. Therefore, to ensure <br />compliance with this standard, the following conditions are warranted: <br />2) Prior to final site plan approval, the applicant shall add compliance with EC <br />9.5500(9) to their list of standards that will be met at the time of building permit. <br />3) Prior to the issuance of a building permit, shall submit plans demonstrating <br />compliance with the standards for private open space at EC 9.5500(9)(b). <br />Alternatively, the applicant may obtain approval of an adjustment review in <br />accordance with EC 9.5500(9)(d). <br />Based on these findings, conditions, and future review, the proposed development will comply <br />with these standards. <br />(c) Open Space Credit. An open space credit, not to exceed 25 percent of the total <br />open space requirement, may be applied toward compliance with that <br />requirement, for developments that are located within one-quarter mile of a <br />public park as measured along the route of the shortest existing public way or <br />private street. <br />Based on the amount of open space being provided by the applicant, this provision is not <br />necessary to meet the applicable open space requirements. <br />EC 9.5500(10) Block Requirements. <br />(a) Block Structure. Multiple-family developments 8 or more acres in size shall be <br />developed as a series of complete blocks bounded by public or private streets.
