I Opinion by Kressel. <br />2 NATURE OF THE DECISION <br />3 Petitioner seeks review of a City of Albany resolution <br />4 approving a site plan, a conditional use permit, a flood plain <br />5 review permit and certain variances to allow construction of a <br />6 factory for the manufacturing of roof tiles. The permit <br />7 applicant, Permawood Northwest Corporation (Permawood), is a <br />€i respondent-participant in this proceeding. <br />9 FACTS <br />10 The 5.28 acre site is located within the Willamette River <br />11 Greenway in the City of Albany. Although it is designated for <br />12 light industrial use on the city's comprehensive plan, most of <br />13 the site is zoned for heavy industrial use. The southwest <br />14 portion of the site is zoned R-2, Medium Density Residential. <br />15 A 16 acre undeveloped park site lays to the east. To the <br />16 northwest is a 5 acre, fully developed park. The Willamette <br />17 River is immediately to the north. To the south are <br />18 residential uses on land zoned R-2. A nonconforming industrial <br />19 use adjoins the site's southern boundary. Another <br />20 nonconforming industrial use is west of the site. Most of the <br />21 nearby property is zoned either for open space or residential <br />22 use. <br />23 There are two businesses on the site, a warehouse <br />24 constructed in 1979 under a conditional use permit and a <br />25 cabinet shop. Prior to 1978 the site was used as an aggregate <br />26 extraction and cement plant. The proposed use involves the <br />Page 2 <br />
