I such changes are to be limited to insure compatibility with the <br />2 greenway goal and policies stated in the plan.14 According <br />3 to the city, the means by which the compatibility objective is <br />4 carried out is the review process for a greenway conditional <br />5 use permit under the development code. In other words, <br />6 satisfaction of the code's permit criteria establishes the <br />7 necessary "compatibility with the greenway goals and <br />8 policies." record at 29. We find this approach reasonable. <br />9 Accordingly, we proceed to consideration of petitioner's <br />10 charges that various code provisions concerning the required <br />11 greenway conditional. use permit have been violated. <br />12 2. Alle ations under Creenwa Permit Criteria <br />1.1 a. Protection of Fish and Wildlife habitat <br />14 Section '11.130(2) of the code requires that "significant <br />15 fish and wildlife habitat shall be protected." The record <br />16 contains evidence that wildlife of various kinds, including <br />17 blue heron, beaver, nutria, and osprey occupy the area. Record <br />18 at 81-67. The comprehensive plan itself recognizes that <br />19 vegetation along the river provides important habitat for <br />20 wildlife and fish. Albany Co-mprehensive Plan at 6. <br />21 Petitioner contends, as it did at the city's hearings, that <br />22 the presence of toxic substances on the site, particularly <br />23 cement, present a threat: to wildlife and wildlife habitat along <br />24 the river. 15 The city's final order rejects petitioner's <br />25 argument.
