parks, provided the city makes findings to demonstrate consistency with constitutional <br />requirements. "Nearby" means uses within % mile that can reasonably be expected to be used <br />by pedestrians and uses within 2 miles that can reasonably be expected to be used by <br />bicyclists. <br />Adequate pedestrian, bicycle, transit circulation, and facilities will be available to users of the subject <br />site. Sidewalks along River Road, Green Lane, and the new connector street will support pedestrian <br />circulation. River Road features shoulders that can accommodate bicycles. Finally, a transit station is <br />proposed on the west side of the subject property, and there are various amenities along the River Road <br />commercial corridor within walking and biking distance. <br />(5)(c) The provisions of the Traffic Impact Analysis Review of EC 9.8650 through 9.8680 <br />where applicable. <br />The anticipated traffic generated by the proposed development does not meet any of the applicability <br />thresholds established in EC 9.8670(1) through (4). Anticipated peak hour trips will not reach the <br />threshold of 100 or more, there are no documented concerns or analyses to warrant further review, and <br />the southern section of the site does not abut a street in the jurisdiction of Lane County. Impacts to <br />Hunsaker Lane will be addressed when development is proposed on the remainder of the subject <br />property. Based on these findings, this criterion is not applicable. <br />Based on the above findings and proposed conditions of approval, EC 9.8320(5) is met. <br />EC 9.8320(6): The PUD will not be a significant risk to public health and safety, including but not <br />limited to soil erosion, slope failure, stormwater or flood hazard, or an impediment to emergency <br />response. <br />Public Works staff confirms that this site is not located within a regulatory Special Flood Hazard Area <br />(per Flood Insurance Rate Map 41039C-1107-F). The development itself will not result in unreasonable <br />risk of flood per the stormwater management evaluation below, at EC 9.8320(10)(j). <br />Due to the level nature of the area of development, soil erosion and slope failure are unlikely. <br />Regarding soil erosion and slope failure, due to the size of the development, an erosion prevention <br />permit will be required prior to any ground-disturbing activities. <br />The Fire Marshal's Office also confirms that the PUD will provide for adequate emergency access. <br />Based on these findings and future permit requirements, this criterion is met. <br />EC 9.8320(7): Adequate public facilities and services are available to the site, or if public services and <br />facilities are not presently available, the applicant demonstrates that the services and facilities will be <br />available prior to need. Demonstration of future availability requires evidence of at least one of the <br />following: <br />(a) Prior written commitment of public funds by the appropriate public agencies. <br />(b) Prior acceptance by the appropriate public agency of a written commitment by the applicant <br />or other party to provide private services and facilities. <br />(c) A written commitment by the applicant or other party to provide for offsetting all added <br />public costs or early commitment of public funds made necessary by development, submitted <br />on a form acceptable to the city manager. <br />June 2019 Staff Report: Santa Clara Transit Station - PDT 19-1/ARA 19-1 Page 12 of 23 <br />
