DOWNTOWN RIVERFRONT <br />LAND USE COMPONENTS <br />CA 19-1, RA 19-1, Z 19-S, WG 19-3, ST 19-3, and SDR 19-2 April 19, 2019 <br />(b) The local government has an acknowledged TSP and the proposed <br />zoning is consistent with the TSP; and <br />(c) The area subject to the amendment was not exempted from this rule at <br />the time of an urban growth boundary amendment as permitted in OAR <br />660- 024-220(1)(d), or the area was exempted from this rule but the <br />local government has a subsequently acknowledged TSP amendment <br />that accounted for urbanization of the area. <br />The 2035 TSP is the City's acknowledged local transportation system plan. Chapter 3: Needs <br />Assessment and Evaluation of the 2035 TSP provides: <br />The needs assessment and resulting projects... that establish a transportation system adequate to <br />meet the identified local transportation needs are based upon the land use designations <br />established by the Metro Plan. Because the 2035 TSP is based on the Metro Plan land use <br />designations, any zone allowed within the land use designation is consistent with both the Metro <br />Plan and this 2035 TSP. <br />As previously discussed, and detailed in the related Zone Change findings, incorporated by reference <br />herein, the recommended zoning of (8) parcels within the subject property from S-W, I=2, and PL to S- <br />DR is consistent with the land use designations in the Metro Plan. Therefore, the proposed zone <br />change is consistent with the 2035 TSP. <br />Because the proposal does not involve amendments to the Metro Plan (or any Refinement Plan) <br />designations, and the proposed S-DR zoning remains consistent with the existing Mixed Use and Parks <br />and Open Space designations, the zone change complies with OAR 660-012-0060(9) and satisfies OAR <br />660-012-0060(1). <br />The /ND Nodal Development Metro Plan overlay designation has also been applied to the entire <br />Downtown Plan area. This designation identifies the Downtown'Plan area as a nodal development, <br />transit-oriented/pedestrian district, in further compliance with Statewide Planning Goal 12. Well- <br />designed mixed-use developments at higher densities which encourage transit use are particularly <br />desired in this area. The proposed amendments and zone change do not affect the /ND designation, as <br />implemented through the S-DR zoning. <br />Based on these findings, the proposed amendments and zone change comply with the Transportation <br />Planning Rule. Therefore, the proposed amendments and zone change are consistent with Statewide <br />Planning Goal 12. <br />Goal 13 - Energy Conservation: To conserve energy. <br />Goal 13 requires that land and uses developed on the land shall be managed and controlled so as to <br />maximize the conservation of all forms of energy, based upon sound economic principles. Goal 13 is <br />directed at the development of local energy policies and implementing provisions and does not <br />establish any requirements with respect to other types of land use decisions. To the extent that Goal <br />13 could be applied to the proposed amendments and zone change, the existing and proposed <br />designations are consistent with statewide planning Goal 13. <br />The proposed amendments and zone change do not specifically impact local energy conservation <br />policies or implementing provisions, except to encourage compact urban development within the <br />`r <br />City of Eugene FINAL SUBMITTAL 25 <br />
