Decision-Making Process <br />The land use applications described above were first considered by the Eugene Planning <br />Commission. At the time of this notice, the Planning Commission's recommendations to the City <br />Council were not yet final. When finalized, the Planning Commission's recommendations may be <br />viewed here: https://pdd.eugene-or.gov/LandUse/SearchApplicationDocuments?file=CA-19-0001 <br />In making their decision on the land use applications noted above, the Eugene City Council will <br />address the relevant approval criteria from the Eugene Code at Sections 9.8065, 9.8424, 9.8470 <br />and 9.4980, 9.8515, 9.8815, and 9.8865. Testimony provided to the City Council is not limited <br />to specific issues. Any written and spoken testimony (evidence and argument) should be <br />directed toward the applicable criteria of the Eugene Code, or other criteria or land use <br />regulations that the person testifying believes to apply to the decision. Following the public <br />hearing, the Council will decide at a separate meeting whether to approve, modify, or deny the <br />proposed ordinance. Council deliberations and possible action is currently scheduled for July <br />17, 2019. <br />Hearing Procedures <br />The public hearing will be held in accordance with quasi-judicial hearing procedures required <br />under the Eugene Code and State law. Issues which may provide the basis for an appeal to the <br />Oregon Land Use Board of Appeals must be raised by the person testifying not later than the <br />close of the record at or following the final evidentiary hearing on the proposal. Such issues <br />shall be raised and accompanied by statements or evidence sufficient to afford the City Council <br />and parties involved an adequate opportunity to respond to each issue. At the public hearing, <br />testimony will first be accepted from the applicant and those in support of the request, then <br />from those that are neutral, then from those in opposition. <br />Failure to raise an issue, with sufficient specificity to afford the decision-maker and the parties <br />involved an opportunity to respond, precludes appeal to the Oregon Land Use Board of Appeals <br />(LUBA). All decisions of the elected officials are final. A party may appeal the decision to LUBA <br />within 21 days of the decision of the elected officials. Appeals to LUBA are governed by ORS <br />197.830 to 197.845. <br />How to Submit Testimony <br />➢ Send a written statement to the City Council by 5:00 pm on June 17, 2019 c/o Allie Camp, <br />Community Development Division, 99 West 10th Avenue, Eugene, Oregon 97401 or by e-mail: <br />ACamp@eugene-or.gov. Statements received by staff by 5:00 pm on June 17, 2019 will be <br />included in the City Council's hearing packet. <br />➢ Send a written statement after June 17, 2019, but before the public hearing. Written <br />statements submitted after 5:00 pm on June 17, 2019, but prior to the public hearing will be <br />provided to the City Council at the public hearing.
