outlines various dates for comments and other details pertaining to the Planning <br />Commission's action going forward to address the November 2018 LUBA remand of <br />the tentative PUD approval of the CHPUD . The Neighborhood Response Committee <br />has a few questions for you. <br />1) Is your office and/or the Planning Commission in receipt of any new material from <br />the Applicant in response to the LUBA remand? As we have previously <br />communicated, the Response Committee is especially concerned that new <br />geotechnical reports from Branch Engineering (or others) be made available to us as <br />soon as they are received. I check the website daily and do not see anything posted <br />yet. It seems unlikely that the Planning Commission would establish such a definitive <br />timeline without having received some (or all) of the Applicant's initial remand <br />response materials. <br />BTW - the 5/16/19 notice, the mailing list it was sent to and the affidavit of mailing are <br />also missing from the website. Also missing is a copy of the Applicant's 5/7/19 written <br />notification to the city requesting the beginning of the 120-day response period. I <br />believe the Response Committee requested a copy of the Applicant's 5/7/19 notice to <br />proceed approximately 10 days ago. I know that the website is not the "official <br />record;" however, the public relies heavily on your website to easily access important <br />documents. <br />2) One of the most disturbing items in the city's notice is in the middle of page two <br />which reads "The Planning Commission will not hold a public hearing as part of this <br />remand process." Over the past few weeks Cathy Johnson and I have communicated <br />with you about the upcoming remand process and were assured several times by you <br />both verbally and in writing that you would provide us with the dates for the public <br />hearing(s) as soon as you knew them. You even mentioned that there might be a <br />need for two hearings to cover all of the new information that is likely to be generated <br />by the remand. Now it appears that the Planning Commission will hold one public <br />meeting (August 6, 2019) to discuss (among themselves) all of the testimony <br />submitted during the three "open-record" periods. However, if I am reading the public <br />notice correctly, this will not be a public hearing during which the Response <br />Committee (or the public in general) may present new materials and visual exhibits <br />submitted during the 1st or 2nd "open record" period? Will the Planning Commission <br />hear a verbal presentation by your department at this meeting? Will you or the <br />Applicant be able to show visual aids to the Planning Commission? Will the record <br />still be "open" at the time of the Planning Commission meeting? <br />3) It appears that the Planning Division will provide a staff report to the Planning <br />Commission at least 7 days prior to the August 6, 2019 meeting. As with the initial <br />staff report on the entire project, the Response Committee requests that a copy of <br />your staff report be immediately made available to us.
