Sustaita, Loren Schein, the City <br />Attorney, and LandWatch Lane County. <br />Hearings Official's Decision <br />The Hearings Official's decision addresses the arguments previously raised by opponents as part <br />of the initial hearing process and, as such, his findings are included herein by reference. <br />Summary of Appellants' Argument <br />Appellants conclude their appeal statement incorporating by reference all arguments by the <br />identified parties. <br />Planning Commission's Determination <br />This appeal issue does not provide a clear argument or specific assignment of error, and <br />therefore lacks sufficient specificity for the Planning Commission to respond any further. <br />V. CONCLUSION <br />The Eugene Planning Commission reviewed the record and the assignments of error in the <br />appeals, and hereby affirms with modification the Decision of the Hearings Official to <br />conditionally approve the Willamette Greenway Permit, Site Review, and Adjustment Review <br />for Lombard Apartments (WG 18-3/SR 18-3/ARA 18-8). The conditions of approval imposed by <br />the Hearings Official and adopted by the Planning Commission are included below for ease of <br />reference. <br />Prior to the issuance of a development permit the applicant shall provide details that <br />identify which features are being used to comply with EC 9.5500(7); and the following <br />note will be added to the Final Site Plan: "Buildings shall comply with the building <br />articulation requirements at EC 9.5500(7)." <br />2. Prior to issuance of a development permit, the applicant shall revise the site plan to <br />demonstrate compliance with EC 9.5650 Recycling - Small Collection Facility Standards <br />and EC 9.6740 Recycling and Garbage Screening. The following note shall also be added <br />to the applicant's site plan: "Recycling and Garbage areas shall comply with EC 9.5650 <br />and EC 9.6740. <br />3. The following restriction shall be required to be shown on the Final Site Plan in <br />accordance with EC 9.6500(3): "No building, structure, tree or other obstruction shall be <br />placed or located on or in a Public Utility Easement." <br />4. The proposed Public Utility Easement shall be conveyed by a separate document <br />meeting City standards in conjunction with the Privately Engineered Public <br />Improvements (PEPI) permitting process. <br />5.
