How to Comment on the Proposal
❖ Submit a written statement to the Hearings Official, c/o Nick Gioello, Associate Planner, Eugene Planning Divi-
sion, 99 West 10th Avenue, Eugene Oregon 97401 or via email nick.r.gioello@ci.eugene.or.us.
❖ Provide written testimony at the Public Hearing. Written testimony may be submitted to the Hearings Official
on the day and time of the hearing.
❖ Attend the public hearing and state your concerns. At the hearing, the Hearings Official will ask for (1) testimony
that supports the request, (2) testimony that neither supports nor opposes the request, and (3) testimony that
opposes the request. You can sign up to provide your testimony at the appropriate time and it will be recorded in
the minutes of the hearing.
❖ Contact your neighborhood organization to discuss this proposal. A portion of land area in this application falls
within the boundaries of the Fairmount Neighbors association. To obtain contact information for the neighbor-
hood association, call the City's Neighborhood Services Office at 541-682-6243, http://www.eugene-or.gov/1128/
Neighborhood-Services
The public hearing provides an opportunity to submit factual information or raise issues concerning the application. If a partici-
pant requests an additional opportunity to submit testimony, the City will accommodate that request either by continuing the
hearing on another date or by holding the record open for more written testimony.
The Hearings Official will issue a written decision on the application, after the public hearing and closure of the public record,
as required by the Eugene Code. The Hearings Official will not make a decision at the public hearing. The applicable proce-
dures for this Type III application are primarily addressed at Sections 9.7300-9.7340 of the Eugene Code. The Hearings Offi-
cial's decision can be appealed to the Eugene Planning Commission.
Keep in mind that failure to raise an issue at the public hearing, in person or by way of written testimony, or failure to provide
statements or evidence with sufficient specificity to enable the Hearings Official to respond to the issue, precludes an appeal
based on that issue. Only those issues raised by testimony, oral or written, as part of the initial hearing process may be raised
in subsequent appeals (to the Eugene Planning Commission, then to the State Land Use Board of Appeals).
Where to Find More Information
The application, related documents, and approval criteria are available for inspection at the Planning Division at no charge;
copies can be obtained at a reasonable cost. As a courtesy, some application materials, as well as general information about
the land use application process and criteria may be available online at http://www.eugene-or.gov/3208/Land-Use-Application
-Information.
To allow community members an opportunity to learn more about the request and to review the staff analysis of the land use
application(s), a written report prepared by staff will be available after 5 p.m. on September 5, 2018 online at:
http://www.eugene-or.gov/AgendaCenter/Hearings-Official-Public-Hearings-8
The report will also be available for review, starting September 6, 2018, between 9 a.m. and 4 p.m. at the Eugene Permit and
Information Center located at 99 West 10th Avenue. Copies of the staff report may also be obtained at a reasonable cost.
For questions or to submit testimony, contact:
Nick Gioello, Associate Planner
541-682-5453 or nick.r.gioello@cieugene.or.us
