How to Comment on the Proposal <br />❖ Submit a written statement to the Hearings Official, c/o Nick Gioello, Associate Planner, Eugene Planning Divi- <br />sion, 99 West 10th Avenue, Eugene Oregon 97401 or via email nick.r.gioello@ci.eugene.or.us. <br />❖ Provide written testimony at the Public Hearing. Written testimony may be submitted to the Hearings Official <br />on the day and time of the hearing. <br />❖ Attend the public hearing and state your concerns. At the hearing, the Hearings Official will ask for (1) testimony <br />that supports the request, (2) testimony that neither supports nor opposes the request, and (3) testimony that <br />opposes the request. You can sign up to provide your testimony at the appropriate time and it will be recorded in <br />the minutes of the hearing. <br />❖ Contact your neighborhood organization to discuss this proposal. A portion of land area in this application falls <br />within the boundaries of the Fairmount Neighbors association. If a partici- <br />pant requests an additional opportunity to submit testimony, the City will accommodate that request either by continuing the <br />hearing on another date or by holding the record open for more written testimony. <br />The Hearings Official will issue a written decision on the application, after the public hearing and closure of the public record, <br />as required by the Eugene Code. The Hearings Official will not make a decision at the public hearing. The applicable proce- <br />dures for this Type III application are primarily addressed at Sections 9.7300-9.7340 of the Eugene Code. The Hearings Offi- <br />cial's decision can be appealed to the Eugene Planning Commission. <br />Keep in mind that failure to raise an issue at the public hearing, in person or by way of written testimony, or failure to provide <br />statements or evidence with sufficient specificity to enable the Hearings Official to respond to the issue, precludes an appeal <br />based on that issue. Only those issues raised by testimony, oral or written, as part of the initial hearing process may be raised <br />in subsequent appeals (to the Eugene Planning Commission, then to the State Land Use Board of Appeals). <br />Where to Find More Information <br />The application, related documents, and approval criteria are available for inspection at the Planning Division at no charge; <br />copies can be obtained at a reasonable cost.
