Therefore, opponents’ TIA arguments do <br />not provide a basis to deny the application. <br /> All of the approval criteria are satisfied. <br />CONCLUSION <br />APPROVES <br />For all the reasons set forth above, the Hearings Official the applications for a <br />Willamette Greenway Permit, Site Review Approval, and Adjustment Review Approval, with the <br />following conditions of approval. <br />CONDITIONS OF APPROVAL <br />1.Prior to the issuance of a development permit the applicant shall provide details that <br />identify which features are being used to comply with EC 9.5500(7); and the following <br />note will be added to the Final Site Plan: “Buildings shall comply with the building <br />articulation requirements at EC 9.5500(7).” <br />2.Prior to issuance of a development permit, the applicant shall revise the site plan to <br />demonstrate compliance with EC 9.5650 Recycling – Small Collection Facility Standards <br />and EC 9.6740 Recycling and Garbage Screening. The following note shall also be added <br />to the applicant’s site plan: “Recycling and Garbage areas shall comply with EC 9.5650 <br />and EC 9.6740. <br />3.The following restriction shall be required to be shown on the Final Site Plan in accordance <br />with EC 9.6500(3): “No building, structure, tree or other obstruction shall be placed or <br />located on or in a Public Utility Easement.” <br />4.The proposed Public Utility Easement shall be conveyed by a separate document meeting <br />City standards in conjunction with the Privately Engineered Public Improvements (PEPI) <br />permitting process. <br />5.Prior to issuance of a building permit, the applicant shall obtain approval of a PEPI permit <br />for the construction of Lombard Street and any associated infrastructure that will be public <br />including the proposed public wastewater line. <br />6.During the PEPI process, the applicant shall provide a street deed to convey the right-of- <br />way for Lombard Street to the City. <br />14 <br />Those decision are Amazon Corner – (TIA 16-7) and Delta Ridge PUD - (PDT 17-3/ ARB 17-2/ TIA 17-2).
