UNIVERSITY OF OREGON <br />NORTH CAMPUS <br />CONDITIONAL USE & WILLAMETTE GREENWAY PERMIT APPLICATION <br />conservation setback in EC 9.4920(1)(c)(1.) or affect inventoried Goal 5 Resources such as water or <br />natural vegetation. According to the provisions at EC 9.3715(2)(a), the Applicant could propose <br />development, including structures, parking areas, streets, and access drives, beginning at 35 feet <br />from the top of bank of the river. However, as illustrated on Sheet L01 Regulatory Plan (Exhibit A), <br />the proposal includes a required 100-foot conservation setback extending from the Willamette <br />River and Millrace top of bank lines. Further, the Applicant proposes a conservation setback of <br />200-feet for buildings and recreational fields along most of the length of the property, as shown on <br />Sheet L01 Regulatory Plan. It is important to note that since this 200-foot setback is determined <br />from the top of bank, the setback equates to 250-300 feet as measured from the waterÈs edge. <br />Based on the above findings, this standard is satisfied. <br />C.13. Wetland, riparian corridor, or wildlife habitat sites inside the UGB <br />identified after adoption of the applicable Goal 5 inventory of significant <br />sites, that have not been previously considered for inclusion in the <br />inventory, shall be addressed in the following manner: <br />a. The jurisdiction within which the natural resource is located shall <br />study the site according to the requirements in the Goal 5 <br />administrative rule. <br />b. Upon the completion of the study, the affected jurisdiction shall <br />determine whether the identified natural resource is significant <br />according to the adopted significance criteria of the affected <br />jurisdiction. <br />c. If the newly identified site is determined significant, the affected <br />jurisdiction shall complete the Goal 5 requirements for the site, <br />which includes adoption of protection measures for sites <br />identified for protection. <br />d. The affected jurisdiction will notify affected property owners and <br />interested parties throughout the process. <br />In prepared by Mason, Bruce & Girard (Exhibit <br /> The Riparian Assessment and Management Report <br />B), MB&G identified several wetlands and oak savannah not included in the inventory that are <br />candidates for inclusion. <br />C.16. The map titled Goal 5 Significant Wildlife Habitat for the area inside the <br />Metro Plan Boundary and outside the UGB, dated January 2004, <br />adopted and incorporated here, shall be used to identify significant <br />wildlife habitat for purposes of notifying the Oregon Department of Fish <br />and Wildlife concerning applications for development permits or other <br />land use decisions affecting significant wildlife habitat on the Goal 5 <br />inventory for areas outside the UGB and inside the Plan Boundary. The <br />map is on file at the Lane County Land Management Division. <br />The map titled Goal 5 Significant Wildlife Habitat was consulted to identify significant wildlife <br />habitat.
