sewage, streets, street trees, street lights, sidewalks, accessways, and stormwater drainage. The <br />applicant proposes all public improvements to be privately engineered and constructed. <br />To ensure compliance with EC 9.6505, an Engineering and Construction agreement is required <br />for the private construction of public improvements, which must be submitted when the <br />construction plans are submitted for review and approval. The configuration and size of the <br />public improvements will be subject to approval by the City Engineer upon review of the design <br />and supporting analysis prepared by the applicant's engineer. If the improvements are not <br />permitted prior to plat approval, a bond for the construction of public improvements will be <br />required prior to final plat approval. These requirements will be further addressed through the <br />subsequent subdivision application process. <br />EC 9.6505(1) Water Supply <br />Finding: As discussed above, referral comments from Eugene Water and Electric Board <br />(EWEB) indicate there is sufficient water to supply the proposed Capital Hill PUD. However, <br />the water system is restricted by the existing infrastructure which does not have adequate <br />capacity to provide the required domestic and fire water flows to the proposed development. The <br />proposed development will require significant upgrades to the EWEB water system, which <br />would include a new pump station and associated piping. As also discussed above, the applicant <br />has committed to contributing to the cost of that infrastructure. Through the "Owner <br />Commitment to Contribute to Cost of Water Infrastructure, signed by both property owners, the <br />have committed "to pay their proportionate share of capital costs required to upgrade EWEB's <br />off-site facilities, as needed to adequately serve the proposed development." <br />The Response Committee objects that the owners' written commitment is insufficient and does <br />not guarantee that they will follow through with the commitment to contribute to the cost of the <br />infrastructure. EWEB, however, has determined the Owner Commitment to Fund Water <br />Infrastructure to be acceptable. Public Works referral comments (page 8-9) note that prior to <br />final subdivision approval the applicant must provide documentation from EWEB ensuring <br />adequate water service. To ensure water is provided as proposed, the approval is also subject to <br />the following condition: <br />Prior to final plat approval, the applicant shall provide documentation that EWEB has <br />received a financial guarantee, ensuring water will be provided to each lot in the plat. It is <br />noted that EWEB currently accepts cash payment, bond, or an irrevocable letter of credit <br />as financial guarantees. <br />Based on these findings, and with the condition of approval above, the standard for water supply <br />will be met. <br />EC 9.6505(2) Sewage <br />Finding: EC 9.6505(2) requires all developments to be served by wastewater sewage systems of <br />the City, in compliance with the provisions of EC Chapter 6. <br />Hearings Official Decision (PDT 17-1) 64 <br />
