Administrative Order (AO) 58-18-01 on February 23, 2018, which removes all on-street parking <br />from Capital Drive between Spring Boulevard and Cresta De Ruta Street. It is expected that "No <br />Parking" signs will be installed on Capital Drive by April 30, 2018. <br />In response to the anticipated measures to alleviate access issues, the Fire Marshals' office <br />provided updated comments on February 20, 2018 that concludes that providing the full <br />unobstructed width on Capital Drive from Spring Boulevard to Cresta De Ruta Street with "No <br />Parking" signs on both sides of the roadway will improve emergency access and evacuation <br />capabilities along the route to the proposed development. <br />Several neighbors expressed serious concerns regarding the existing problems of fire trucks and <br />other emergency vehicles accessing the neighborhood. Several noted the difficulties of fire <br />trucks turning around on the narrow roadways. One neighbor argued that the Fire Department <br />"has clearly said that it [the proposed development] is an impediment to emergency response, <br />even with no parking signs on Capital Drive." He argues that when the Fire Department "clearly' <br />states this PUD will be an impediment, the city cannot guarantee that it will not be. (March 30, <br />2018 email correspondence from CW Murchison). <br />As discussed above, the Fire Marshal's office comments indicate that the parking prohibition <br />leading to the proposed PUD could alleviate current issues in navigating the existing street <br />system. The February 20, 2018 comments do not state that, with the addition of no-parking signs, <br />the proposed development would create an impediment. Moreover, to the extent the emergency <br />response issues relate to the ability of trucks to maneuver and turnaround, the proposed PUD <br />could improve the existing situation. By providing a loop road (Cupola Drive) near the end of <br />Capital Drive, emergency vehicles can more efficiently maneuver the streets. Eliminating the <br />need to turnaround, the vehicles can negotiate the existing street system more efficiently. <br />Based on the Fire Marshal's updated comments, and with the addition of a loop street that allows <br />greater maneuverability of emergency vehicles, the evidence in the record indicates the proposed <br />PUD will not be an impediment to emergency response <br />EC 9.8320(7) Adequate public facilities and services are available to the site, or if <br />public services and facilities are not presently available, the applicant demonstrates <br />that the services and facilities will be available prior to need. Demonstration of <br />future availability requires evidence of at least one of the following: <br />(a) Prior written commitment of public funds by the appropriate public <br />agencies. <br />(b) Prior acceptance by the appropriate public agency of a written commitment <br />by the applicant or other party to provide private services and facilities. <br />(c) A written commitment to provide for offsetting all added public costs or <br />early commitment of public funds made necessary by development, <br />submitted on a form acceptable to the city manager. <br />Finding: The applicant has provided evidence regarding the adequacy of the public facilities and <br />services available to the site <br />Hearings Official Decision (PDT 17-1) 54 <br />
