Attachment C
> p 541.682.5453
> f 541.682.5572 Attachment B
> nick.r.gioello@ci.eugene.or.us
> -----Original Message-----
> From: James G Harper {mailto:harperj@uoregon.edu]
> Sent: Tuesday, December 19, 2017 12:34 PM
> To: GIOELLO Nick R <Nick.R.Gioello@ci.eugene.or.us>
> Subject: Capital Hill P.U.D.
> Dear Mr. Gioello,
> I am writing to strongly object to Tom and Cindy Dreyer's plan to
> develop their ridgeline property at the top of Capital Drive. Tom and
> Cindy are good friends of mine, but as much as I love them I cannot go
> along with their scheme, which represents a TAKING from the
> neighborhood and from all Eugene.
> Here are a few of the ways that this is a TAKING. The first point is
> about TAKING from the citizens of Eugene, the second about TAKING from
> the neighbors and the third about TAKING from the city itself:
> The property sits on a ridgeline, land that is designated as
> sensitive in the South Hills Study. This is, I suspect, why the
> uppermost section of the land received a PUD overlay. The "P" in PUD,
> as I hardly need remind you, stands for "Planned." Thorough planning
> would have a lasting tree conservation plan so that the ridgeline
> (visible from all around town) does not end up looking like a
> clearcut.
> Tom and Cindy Dreyer's scheme is a simple subdivision, with a minimal
> amount of planning. It will result, in the initial site preparation
> and in the long run (with individual owners cutting trees at will) in
> a TAKING of the ridgeline from all citizens of Eugene.
> The development plan will also result in the overstressing of an
> infrastructure that is not even sufficient for the current residents.
> I live on Capital Drive, and know that the house to the south of me
> and the house two doors to the north of me have both burned. We also
> see car accidents and near accidents constantly on our twisty roads
> (most recently a truck flew off the road into Peggy Fisher's front
> yard). Tom and Cindy Dreyer's scheme is a TAKING of our safety.
> The city knows all this, and more, already. And the neighbors, who
> have voted 97 to 3 against the Dreyer scheme (Fairmont Neighborhood
> Organization) will be providing further testimony at the upcoming
> public meeting. If the city approves the Dreyer scheme and the
> development goes forward there will be DEATH, INJURY and PROPERTY
> DAMAGE. Because the city has been warned through expert testimony, he
> city will be held liable. Thus liable the city, in any lawsuit
> payout, will lose money.
Page 354
