TheCommitteenotesthatatruenightmarescenariowouldbecausedbyvehiclecollisionsat <br />points,suchasthe5-wayintersectionwhereSpringBlvd.,CapitalDr.,WoodlawnAve.,and <br />MadronaDr.meet,blockingalluphillanddownhilltrafficatthatpoint.Emergencyvehicles <br />wouldthenbeblockedfromaccess,forcingthemtoabandontheirvehiclesandruntherestofthe <br />wayupthehillwithequipment.Residentsfleeingwouldalsobeblockedinthisscenario.Some <br />couldabandontheirvehiclesandproceeddownthehill,butthiswouldfurtherexacerbatethe <br />problemwithaccess.Otherswhoarenotabletomakethewalkdownduetoanynumberof <br />reasons,includingbutnotlimitedtodisability,infirmity,andagewouldbetrappedabovethe <br />intersectionfacingthegravedangerofafireoutofcontrolduetodelayedresponsetimes. <br />TheApplication(p.47of67)makesanattemptatmitigatingthisdangerinawoefully <br />inadequatewaybywritingthat“Allproposeddwellingswillberequiredtohavesprinklers, <br />therebyreducingtheriskofthespreadoffirefurther.”Thisproposedremedyisnotonly <br />inadequatebutalsounenforceable.ThereisnoEugeneCityCodetoenforcethisproposal,noris <br />thereanywaytoenforceorensurethatthehomesthatwouldbeeventuallybuiltwouldactually <br />havesprinklersoncetheproposedPUDwasapproved.SincenoCCRsareproposedorincluded, <br />theseclaimsaresimply“aspirations,”asApplicationcallsanystatementregardingCCRs(p.30 <br />of67).Regardingsprinklers,Applicationstates: <br />“Allnewunitsdevelopedonthesubjectpropertywillbesprinklered,whichisanoption <br />typicallysupportedbytheFireDepartmentstaffwhensecondaryaccessisnotavailable. <br />Thisaspectcanbereviewedattimeofbuildingpermit”(p.41of67). <br />Thus,whilesprinklers“willberequired”ononepage,theyare“anoption”thatcanbe <br />“reviewed’onalaterpage.Wemustemphasizethatsprinklersinhouseswouldnotbemuch <br />helpinawildfire.Furthermore,sprinklersinthehousesarecitedasaremedytomitigatethe <br />absenceanysecondaryemergencyaccess,buttheconditionalapprovalrecommendedbythecity <br />doesnotincludesprinklersinthehousesasaformalizedcondition.Thisleavestheneighborhood <br />withnosecondaryemergencyaccessandnowaytoensureevenaninadequateremedy, <br />sprinklersinhomes.Thispresentsaclearthreattopublichealthandsafety. <br />AnexampleoftheFireDepartment'sdifficultyaccessingCapitalHillandtheproposedCHPUD <br />siteoccurredinJuly2017duringSanipac'sWednesdayrounds.AstheSanipactruck(oneof <br />theirsmallest)headedtowardFairmountBlvd.,EugeneFiretruck#13fromthelocalUniversity <br />Stationtriedtoheadupthehill.Unabletopass,amemberoftheFirecrewdirectedastheFire <br />truckbackeddownSpringBlvd.untilitcouldbeturnedaroundattheintersectionofFairmount <br />Blvd.\[See EC9.8320(11),p.163\] <br />79 <br /> <br />
