ProtectionofHealthyTreesHavingaReasonableChanceofSurvival: <br />TheApplicationclaimstoplanto“conserve”401ofthe867trees(46%)ontheproposed <br />CHPUDsite.Ofthese,40are“technicalfelling”trees—treesthatwilllikelydiebecausethe <br />criticalrootzoneswillbecompromisedbyconstruction.Another234ofthe401treestobe <br />conserved(58%)areidentifiedbytheApplicationasin“poor”condition.BytheApplication’s <br />owndefinition,these“conserved”treeswouldbeoflittlevalue.Inotherwords,58%ofthetrees <br />theApplicantplanstoconservearein“poor”condition,bytheApplicant’sowndefinition. <br />Bycuttingdownscoresofhealthytreesandproposingtosavetreestheydefineasin“poor” <br />condition,theproposedCHPUDfailstosatisfyEC9.8320(4)(b)1.and7. <br />ProtectionofTreesandStandsofTreesLocatedAlongRidgelinesandWithinView <br />Corridors: <br />ThetreesintheproposedCHPUDarelocatedintwomainareas:ontheridgelineabove901feet <br />andalongtheeasternslopefacingLaurelHillValley.Thenorthernboundaryoftheproposed <br />CHPUDiscontiguouswithHendricksPark;theeasternboundaryoftheproposedCHPUDis <br />contiguouswiththeRibbonTrail. <br />ThedatacontainedintheTreePreservationPlanisdesignedtoconcealthetruedevastationto <br />theridgelineandthesurroundingparksthatwouldresultfromtheproposedCHPUD. <br />Ofthe401treestobeconserved,justfourexistonthepropertyatorabove901'.Themajorityof <br />conservedtrees(235or58%)are14inchesindiameterorunder—treesoflessvaluetothe <br />stabilityoftheslope,thesustainingofforesthealth,screening,andmaintenanceoftheviewshed <br />oftheridgeline. <br />ThoughtheApplicationdifferentiatesbetweentreestoberemovedbytheCHPUDaspartofthe <br />right-of-way(ROW)andtreesthatcanberemovedas“discretionary”treesbythepotential <br />purchaserofthelot,itisreasonabletoassumethatwithsmalllotsizes,mostofthelarger <br />“discretionary”treeswillbecutdownintheprocessofconstructinghouses. <br />Forinstance,alookatthecriticalrootzonesonlot1(p.8ofSupplementalMaterialssubmitted <br />byApplicant1/26/18,S-1Survey)indicatesthatalmostallthetreeswilleitherbecutdown <br />directlyorbecome“technicalfelling”treesintheprocessofconstructinginfrastructureanda <br />home. <br />InTable1below,wecountedtreesinthe“ROW”and“discretionary”treesthat“canbe <br />removed”intheconstructionprocessorthereafter.Thechartdemonstratesthatahigher <br />percentageofthelarger,more“significant”treeswillberemoved.Ofthe361treestobe <br />conserved(aftersubtractingthe“technicalfelling”trees),only94(10%ofthetotaltrees)areof <br />significantsize—21inchesindiameterorgreater. <br />51 <br /> <br />
