EC9.8320(4)ThePUDisdesignedandsitedtominimizeimpactsonthenatural <br />environmentbyaddressingthefollowing: <br />(a)ProtectionofNaturalFeatures. <br />1.ForareasnotincludedontheCity’sacknowledgedGoal5inventory,the <br />preservationofsignificantnaturalfeaturestothegreatestdegreeattainable <br />orfeasible,including: <br />a.Significanton-sitevegetation,includingrareplants(thosethatare <br />proposedforlistingorarelistedunderStateorFederallaw),and <br />nativeplantcommunities. <br />b.Alldocumentedhabitatforallrareanimalspecies(thosethatare <br />proposedforlistingorarelistedunderStateorFederallaw). <br />d.Wetlands,intermittentandperennialstreamcorridors,and <br />riparianareas. <br />2.ForareasincludedontheCity'sacknowledgedGoal5inventory: <br />a.Theproposeddevelopment'sgeneraldesignandcharacter, <br />includingbutnotlimitedtoanticipatedbuildinglocations,bulkand <br />height,locationanddistributionofrecreationspace,parking,roads, <br />accessandotheruses,will: <br />(1)Avoidunnecessarydisruptionorremovalofattractive <br />naturalfeaturesandvegetation,and <br />(2)Avoidconversionofnaturalresourceareas... <br />b.Proposedbuildings,road,andotherusesaredesignedandsitedto <br />assurepreservationofsignificanton-sitevegetation... <br />PerthestaffreportissuedFebruary28,2017(p.20of62),the"subjectpropertyisincludedon <br />theCity'sacknowledgedGoal5inventory,pertheApril12,1978ScenicSitesWorkingPaper, <br />whichdesignatesthesubjectsiteasNaturalSitesofVisualProminenceandProminentand <br />PlentifulVegetation.Assuch,theprovisionsof EC9.8320(4)(a)(2)areapplicabletothe <br />proposedtentativePUD." <br />TheLaurelHillValley,andspecificallytheareaproposedfordevelopmentbytheCapitalHill <br />PUD,isoccupiedbyand/orcurrentlyprovidespotentialhabitatfornumerousanimalspecies <br />(aquaticandterrestrial).RegardingarecentPUDapplicationintheLaurelHillValley(PDT-13- <br />0003),RichPastorandKhanDhillon,twoprofessionalfisheriesandwildlifebiologistslivingin <br />theLaurelHillValley,compiledalistofmanyspecies(commonandscientificnames) <br />documentedtooccurwithintheareaoftheproposedLandmarkdevelopment,orforwhich <br />habitatexistedattheproposedLandmarkPUDsite(AttachmentJ).Manyofthesespeciesare <br />consideredrare,speciesofconcern,sensitive,orvulnerablebystateregulatoryagencies.Itis <br />safetoassumethatspecieswhosehabitatisriparian/uplandwouldbeaffectedbytheremovalof <br />habitatatthesiteoftheproposedCHPUD.ThePUDproposestoremovemuchofthevegetation <br />onthebuildableportionofthesite,whichwouldresultinthedestructionandlossofasubstantial <br />amountofexistinghabitat.Itmayresultindisplacementofindividualsofthesespecies,andit <br />mayresultinharmtosomeindividualsthroughinjuryordeath.Asaresult,theproposedPUD <br />doesnotcomplywiththerequirementfor“ProtectionofNaturalFeatures”asdescribedin EC <br />9.8320(4)(a)1. <br />47 <br /> <br />
