1.Developmentofindividualresidencesonexistinglots;and <br />Theapplicationstates(p.24of67):"CapitalHillPUDproposesindividualresidenceson <br />existinglotsthataretobesubdividedintosmallerlotstoaccommodatemultipleunits." <br />TheproposedCHPUDplanstosubdividethefiveexistinglotsintoatotalof34lots,with34-38 <br />possibleresidences,onaridgelinepropertyinEugene'ssouthhills.Ofthose,22of34proposed <br />lotsarepartiallyorwhollyat901'orabove.Allofthelandproposedfordevelopmentexists <br />above701'. <br />Theportionoftheproposeddevelopmentintheareaabove901'doesnotqualifyforthe <br />exceptiondescribedin EC9.9630(1)(a)1.becauseitproposes24newlotsabovethe901foot <br />elevation. <br />2.Developmentunderplannedunitdevelopmentprocedureswhenitcanbe <br />demonstratedthataproposeddevelopmentisconsistentwiththeadopted <br />SouthHillsStudyRidgelineParkpurposestatementwhichprovidesany <br />areasrecommendedforpreservationorparkusageshouldserveatleastone <br />ofthefollowingpurposes: <br />TheApplicationstates(p.26of67)that"theproposedPUDwillcomplywithfouroftherelevant <br />purposesofthestatedRidgelineParksectionoftheSouthHillsStudy."Thefollowingtwo <br />purposestatementsarediscussedbelow: <br />a.Toinsurepreservationofthoseareasmostvisiblyapartoftheentire <br />community. <br />f.TocontributetoEugene’severgreenforestedge. <br />TheApplicationclaims(p.25of67):“WhiletheSHSfocusesonthehighestareas(above900'), <br />inthiscase,thehighestareasaretheleastvisiblefortheentirecommunity.”TheApplicant <br />providesthephotobelowasevidencefortheirstatement.Thehouseindicatedatthetopofthe <br />photographisvisiblebecausetheApplicantclearcutandremovedallthetreesinanemptylot <br />acrossfromsaidhouseonasteepslope.Thetreeremovalclearlydemonstratesthevisualeffect <br />ofextensivetreeremovalandisasampleofhowtheproposedCHPUDwouldrenderthefuture <br />homesites,andfuturehomes,clearlyvisible.Thetreeremovalwoulddiminishtheviewshed <br />above901'thattheSouthHillsPlanseekstoprotect. <br />20 <br /> <br />
