incomelevels.InasubsequentfilingofSupplementalMaterials(11/28/18),applicant’s <br />representativemodifiedtheproposaltoaddasecondlotwiththesamevariableoption(thus,two <br />lotsof34total).Perhapsthiswasamodificationduetotheidentifiednon-conformingmultiple <br />rentalunits,whichEugeneCodeComplianceServicesorderedtoberestoredtoasinglefamily <br />dwelling.Inregardtothisadditionalvariablelot,whichalsohasnoguaranteethatitwouldbe <br />developedasmorethanasingleunit,applicant’srepresentativenowclaimsthesetwolotsofan <br />uncertainnumberofdwellingsshouldberegardedas“missingmiddle”housingopportunities– <br />withoutanyestimateofcosts(SeeApplicant’scoverlettertosupplementalmaterialsfiling <br />11/27/2017). <br />Itisdisingenuousatbest,orsimplyinaccurate,toclaimthattheproposedCHPUDwillfulfill <br />goalsforaffordable,orlow,ormoderateincomehousingunderCoderequirements.Althoughthe <br />Applicationgivesnoestimateofcostsforlotsorhouses,wecanestimatethatafinisheddwelling <br />willbemultiplesofatleasttwotothreetimesthecostofanaveragethree-bedroomhouse <br />includedinthemultiple-listingdataabove($337,000asof8/31/17)andthusaffordablebyonly <br />aboutthetopone-fifthofEugenehouseholds. <br />Applicationstates(p.35of67):“themajorityofthehouseswithinclosestproximitytothe <br />developmentsiterangefrom…2000–4000sf.Thisproposeddevelopmentwillbe <br />constructedsimilarly.” <br />Obviously,Applicationcannotpredicthowhouses“will”beconstructed,sincethisisnotpartof <br />theproposal.Infact,theApplicationdirectlyrejectsanyresponsibilityforhowhouseswillbe <br />constructed:“Itisprematuretobepreparingcovenantsandrestrictionsand\[sic,“at”\]thispoint <br />intheprocess”(p.30of67).However,thisadmissionofhomesizedoescontradictapplicant’s <br />claimsof“range”and“variety”ofhousingthatwouldbeavailable,especiallyforlowincome <br />households. <br />Inconclusion,wehaveshownindetailthefailureoftheproposedPUDtosatisfyanyofthecode <br />requirementsforhousingin PolicyA.17: <br />•itwouldnotprovide“afullrangeof…housingtype”–onlytwolotswouldhavean <br />optionforthebuyertochooseeitheroneunit,ortwoorthreesinglefamilyattachedunits;all <br />therestofthe32otherlotswouldrequireasinglefamilydetachedunit; <br />•itwouldnotprovide“afullrangeof…density”–alllotswouldbeclusteredinaconfined <br />arrangement,duetosteepslopesoftheacreageandtheintentoftheApplicanttomaximize <br />densityforprofitability; <br />•itwouldnotprovide“afullrangeof…size”–becausesizewillbeadecisionofthe <br />buyers;theapplicationhasnoevidenceregardingpossiblehousesizes.Themoreprobable <br />assumptionisthatnohousesofsmallormoderatesizeandcostwouldbebuiltonlotswhich <br />alonewouldcostmorethan$200,000;theissueisnotwhetherahouseis2,000or4,000 <br />squarefeet,butthefactthattheywouldallbeatthelargeorverylargeendofthescalefor <br />custombuilthomes; <br />14 <br /> <br />
