EC9.8320(12)Theproposeddevelopmentshallbereasonablycompatibleandharmonious <br />withadjacentandnearbylanduses. <br />Applicationstates:“Thewords‘compatible’and‘harmonious’havenodefinitioninthelanduse <br />code,whichmeansadiscussionofthesequalitiesispurelysubjectiveandopentomuch <br />interpretation.Thereisnothingclearorobjectiveaboutthiscriterion”(p.62of67). <br />Thisclaim,whichdenigratesanyopinionorjudgmentthatisnotbasedon“clearorobjective” <br />requirements,issimilartooneissuedinitiallyinthe“Note”(p.12of67):“Withoutclearand <br />objectivemeasuresagainstwhichtoevaluate…,thedecisionmakingpathbecomesoneof <br />subjectivity.” <br />HeretheApplicationallegesthatthereisanoperationaldistinctionbetweencriteria,ontheone <br />hand,thatcanbemeasuredobjectivelyand,ontheotherhand,allothercriteriaorstandards, <br />whichmustthenberegardedasmerelysubjective.Thisisaprofoundfailureofreasoningand <br />describingthedecision-makingprocess.Applicationassertsafalsebinary.Itisnotthe <br />oppositionofobjectivevs.subjectivethatisatissue.Rather,whatisatissueistheaccurate <br />differentiationbetweenquantitativeandqualitativemattersathand.Thus,therearesomecriteria <br />thatare,inwholeorinpart,addressedbyobjectivelyverifiablemetricsanddata.Othercriteria– <br />indeed,oftenmanythatareofcrucialimportanceintheactualworld–reflectdiscretionary <br />qualitativestandardsandvaluesthatmustbeaddressedbylogicalanalysisandargumentation <br />providingthebasisforrational,impartialdeliberationandjudgment.Thisproperlydescribesthe <br />truedecision-makingprocess.Itisnot“clearandobjective,”ononehand,andeverythingelseas <br />merelysubjective,anecdotal,discretionary,arbitrary,andinferior.Rather,qualitativeissuescan <br />beevidence-based,factual,valid,appropriate,andweightyintheirownright. <br />AsApplicationoffersadescriptionof“thevariednatureoftheexistingneighborhood,”it <br />includes“alowqualityapartmentbuilding(3unit),traditionalsinglefamilydetachedhomes, <br />andhighqualitylargesinglefamilyhomes”(p.62of67).Ironically,thisthree-unitbuildingis <br />theoneownedbytheApplicantandsubjecttotheNoticetoCorrectfromEugeneCode <br />ComplianceServicesregardingthenon-conformingconversionofasinglefamilyresidencetoa <br />multi-unitdwelling,whichmustbereturnedtoR-1state(Seeletter,January23,2018, <br />AttachmentG). <br />Thus,itisclearthatthelegaldwellingsnowexistingontheproposedCHPUDsitemustbeR-1 <br />singlefamilydetachedresidenceswithatleastnormalminimalfrontage,whichisanidentical <br />requirementforalmostallofthehouselotsintheSpringBlvd.andCapitalDr.neighborhoodsin <br />proximitytotheproposedCHPUD.Whatisnot“reasonablycompatibleandharmonious”with <br />theseneighborhoodsisadenselyclusteredlotplanaroundanarrowlooproadwayandeven <br />narroweraccesseasements.ThepicturesthatApplicationoffersofhouses“typicaltothis <br />neighborhood”(pp.63-65of67)onlysupportourcontentionofnormal,conformingfrontage. <br />Otherthanthat,thepicturesareirrelevant,giventhefactthatnohousesareproposedtobebuilt <br />byApplicant.Thus,whateverschematicdrawingsorvideospresentedbyApplicantandtheir <br />representativesarehypotheticalandfictional.Thereisnowaytopredictorcontrolwhat <br />individualdwellingswilllooklike,regardingscale,bulk,andheightifproposedCHPUDis <br />approved.Theonefactwecanknowfromtheproposedsiteplanisthatthedenseclusteringof <br />175 <br /> <br />
