“Thisdevelopmentproposesappropriateinfill,consideringtheunderlyingzoning,whilealso <br />minimizingimpactstoexistingneighborhoods.” <br />Beyondthesetwosentences,nodescriptionsaregivenastowhatimpactswouldbeproduced <br />andnoevidencegivenaboutwhatactionsApplicantwouldtakefor“minimizing”ormitigating <br />suchimpacts.Ofcourse,therearehugeimpactsontheseindisputablyhistoric,long-established <br />neighborhoodsofFairmountandLaurelHillValley.Iftherewerenosuchimpacts,therewould <br />benoreasonableobjectionsbytheexistingneighborhoodresidents.Thereareseriousobjections <br />toimpactsthatwouldbeproducedbothwithintheproposedsiteandalsowithinoff-siteareas <br />bothinproximitytotheproposedCHPUDandbeyondinthecityview-shedwherevervisible. <br />AmongthemostseriousandirreversibleimpactsoftheproposedCHPUDonthehistoric <br />neighborhoods: <br />•itwouldjeopardizethesafetyofpedestrians,motortraffic,andemergencyservices <br />responsetime,especiallytheabilitytonavigate,throughouttheexistingneighborhood <br />roadwaysandtheproposedprivateroadbyincreasingtrafficvolumeonnarrowstreets;\[See <br />EC9.8320(5)(b),p.65,and(11),p.163\]; <br />•itwouldforcehousingtobeconstructedonsteepslopesduetoclusteringoflotsfor <br />increaseddensity;\[See EC9.8320(1)PolicyA.10 andbelow EC9.8300(1)(e)\]; <br />•itwouldnotprovideatruly“mixeduse”development,butratherwouldresultinallsingle <br />familydetached,highpriceddwellings(withthepossibleexceptionofthetwolotswiththe <br />optionforeachtoincludeeitheroneunit,ortwoorthreeattachedsinglefamilyunits);\[See <br />EC9.8320(1)PolicyA.17,PolicyA.20 andbelow EC9.8300(1)(c)\]; <br />•itwouldcutandremovebetween43%and51%ofthe926treesgreaterthaneightinchesin <br />diameter,whichwouldincreaselandslidepotentialandexposeadjacenttreesinHendricks <br />ParkandtheRibbonTrailtosignificantdamageandwind-throw\[See EC9.8320(1)Policy <br />E.2,(2)andbelow EC9.8300(1)(d)\]. <br />TheApplicationpresentsamisleadinganderroneousstatement:“thattheunitsareclustered <br />aroundthetransportationsystem”(p.21of67).Wehavearguedthroughoutthatthedense <br />clusteringformaximumeconomicbenefitoftheApplicantisnot“effectivelydesignedinfill.” <br />Moreover,Applicationmakesreferenceto“thetransportationsystem”oftheproposedCHPUD, <br />whichisamisnomerandinaccurate.“System”isdefinedasa“set”or“number”ofrelatedthings <br />thatareunifiedintoacoherentwhole.Applicationproposesnotasystembutone“Private <br />Roadway”(p.10of67)thatloopsbackonitselftotheexistingCapitalDr.Thusthereisonly <br />oneaccessoregresstotheproposeddevelopment,whichwouldproducedangersandan <br />impedimenttoresidentsandemergencyresponse\[See EC9.8320(5),p.58and(11),p.163\]. <br />TheApplication’sdismissivetreatmenthereisevidentfromitsignoringtheissuesandsimply <br />referringto PolicyA.11.Withoutanyevidence,itclaimsthat“densityproposedissimilartothe <br />existingdensityinthedevelopedneighborhoodstothewestandsouth”(p.21of67).Thisis <br />obviouslychallengeablebecausehomesintheadjacentneighborhoodsarealmostallonlotsthat <br />12 <br /> <br />
