wouldsuggesttoanyreasonabledriverthattheyshouldproceedslowly.Whiletherewill <br />alwaysbedriversthattestthelimitsofsafety,itisthedriverthatmakestheroadunsafe–not <br />theroaditself.” <br />Thefirststatementabouttrafficcalmingistotallyfalse.Therearenophysical“calming <br />measuresinplace.”Residentshaveaskedforyearsforinstallationofspeedbumpsorother <br />devices,butthecityhasrefusedduetointerferencewithemergencyresponsevehicles.Therest <br />ofapplication’sstatementisineffectualandhardlycanbetakenseriously.Notethattheelevation <br />differentialbetweentheSpringBlvd./FairmountBlvd.intersectionandthetopofCapitalDr.is <br />over340feet.Trafficregularlyspeedsupandcoastsdownat25to35mph.Toclaimthatthe <br />existingroadwaysarenotacausativefactorfortrafficspeedisunconscionable. <br />Tosayit’snottheroadbutthedriverswhoareresponsibleignorestheacknowledged,world- <br />widefactsofhowincreasedvehiclesafetyandreductionsofdeathandinjuryhavebeenachieved <br />--notsimplybyeducationofdriversbutprimarilybyimprovementsinvehicledesign,especially <br />seatbelts,airbags,andcollapsiblesteeringcolumns.Thetakeawayhereisthattheresponsibility <br />forsafetyonthesenarrowroadscannotbeshiftedtotheusersonly.Increasedvehicleand <br />pedestriantrafficduetotheproposedCHPUDwouldnotleadtomoretrafficcalming,butrather <br />toincreaseddangersontheexisting,limitedroadwaysprovidingtheonlyaccessandegressto <br />theproposedCHPUD.TherearenoproposalsorexpectationsthattheCitywouldwidenthe <br />neighborhoodroadnetworkfromFairmountBlvd.toSpringBlvd.toCapitalDr.attheboundary <br />oftheproposedCHPUD.Thecostswouldbeprohibitive,givengeography,housesclosetothe <br />streets,andrelocationofutilities.Consequently,itistheresponsibilityoftheCity,throughits <br />applicationandenforcementofitslawsandcodes,toensurethatitscitizenscanliveinasafe <br />environment. <br />ThesenarrowneighborhoodroadnetworkthatwouldconnecttheproposedCHPUDtothe <br />externalworldalreadypresentsafetychallengesandwouldbeseverelyimpactednotjustby <br />additionalvehicles,butalsobydangersfromadditionalsharingofthenarrowroadways.Itisnot <br />justthenumericaldata,suchasvolumeoftrafficornumberofpeakhourtrips,thatisimportant <br />here;rather,itistheactualencountersofvehicletrafficwithotherusersoftheroadway– <br />motorizedornot–wheretherearenosidewalks,whereonelanemaybeblockedbyparkedcars, <br />deliveryvehicles,orservicevehicles.Or,regularly,whentwovehiclestravelinginopposite <br />directionsattempttopass–whetherornotonelaneisobstructed.Especially,whencarspass <br />trucksortwotruckstrytopass,theresultistrafficatacrawltoavoidaccidentalcontact.Then <br />othertraffic,comingfromaroundthefrequentblindcurves,dangerouslyemergesuponblocking <br />vehiclesandpedestrianssuddenlyinview.Ifthisiscalledpassivetrafficcalming,thenitcan <br />alsobecalledfrighteningandlife-threateningbythoseinvolved. <br />TheimpedimenttoemergencyresponsenotjustlimitedtowithintheproposedCHPUDsite.Itis <br />realandwouldimpactallthe112existinghouseholdsintheaffectedaccessarea,aswellasthe <br />abilityofemergencyresponderstoreachtheproposedCHPUDsite.(See EC9.8320(6),above.) <br />Forexample,onJuly19,2017,atabout10:30am,someresidentsat2350and2360SpringBlvd. <br />th <br />noticedthatEugeneFiretruck#13,fromthelocalUniversityStationonAgateSt.andE.17 <br />Ave.,wasstoppedinthemiddleofthestreet.Thenitwasbeingdirectedbyoneofthecrewto <br />backdownSpringBlvd.untilitcouldbeturnedaroundattheintersectionwithFairmountBlvd. <br />168 <br /> <br />
