upanddownthenarrowfeederroadsthatprovidetheonlyaccessandegresstotheproposed <br />CHPUDsite\[Seeourdiscussionsofthecodecriteriarelatingtotransportation,traffic,safetyand <br />emergencyresponse:EC9.8320(1)PolicyA.11,PolicyJ.8,(5)(b),(6),(11\]). <br />Under EC9.8320(1)PolicyA.11 wedemonstratethatthecrucialissueisnotsimplythe <br />CHPUD’sdistanceorproximitytoavailableservices,butratherthatthegeographyisthe <br />determiningfactorforvehicleuse.Attheelevationgainofatleast460feetfromthevalleyfloor <br />tothe900footleveloftheCHPUDsite,overthedistanceofoneandone-halftotwomiles,it <br />canbereasonablyassumedthatfewresidentsorserviceworkerswouldwalkorbikealongthe <br />dangerous,narrowroadwaysfortheircommute,business,school,recreation,orserviceworkto <br />andfromtheproposedCHPUDsiteatthetopofCapitalDr. <br />Consequently,theapplicationfailstomeetandwouldneverbeabletocomplywith(1)(b) <br />regarding“alternativestotheuseoftheautomobile.” <br />(c)Avarietyofdwellingtypesthathelpmeettheneedsofallincomegroupsinthe <br />community. <br />Applicationstates(p.14of67):“Thewidevarietyofbuildingandunittypeswillprovidea <br />rangeofoptionsandpricescreatingopportunitiesforresidentsacrossarangeofincome <br />groups.…Itistheclient’sintenttocreateopportunitiesforavarietyofincomelevels.” <br />Theseareanothersetoffalseandunsupportableclaims,certainlyoneofthemostegregious. <br />SimilarfalseclaimswereinitiallystatedintheApplication’s“ProposedUseofProperty(p.5of <br />67)and“Note”(p.12of67).TheclearandobjectiveevidenceofEugenehousingcostsand <br />incomelevelsconfirmsthatpricesforlotsandforconstructingdwellingsintheproposed <br />CHPUDwouldbewellbeyondtheaffordabilityofallbutthoseatthehighestincomelevels.The <br />proposalisnotwhatisunderstoodandacceptedas“affordablehousing”forthoseindividuals <br />andfamiliesatlow,middle,andlimitedincomelevels,orevenforthoseinthequartileabove <br />averagehouseholdincome.Rather,theproposalisforhousingaffordablebythewealthywith <br />cashand/orahighcreditrating. <br />Seeespecially,EC9.8320(1)PolicyA.17p.13,PolicyA.20,p.15 and EC9.4300(4)above, <br />forapplication’ssimilarerroneousstatementsabouthousingtypesandcosts. <br />Consequently,theapplicationfailstocomplywith(1)(c).Thecodestatementmustbe <br />literallyconstruedthat“avarietyofdwellingtypes”ispredicatedon“theneedsofall <br />incomegroups.” <br />(d)Preservationofexistingnaturalresourcesandtheopportunitytoenhance <br />habitatareas. <br />Applicationstates(p.14of67):“Thelotsandassociatedcirculationaresitedanddesigned <br />topreserveasmanynaturalresources,habitatareas,andtreesaspractical.…Theexisting <br />roadwillbeimprovedandwidenedtocurrentstandards,butwillbebuiltinawaythat <br />createsonlyminordisturbanceofexistingnaturalresources.” <br />143 <br /> <br />
